ICE rejects California law, arrests people at courthouse

SAN FRANCISCO (AP) U.S. immigration agents arrestedtwopeople at a Northern California courthouse, including a man detained in a hallway on his way to a hearing,floutinga new state law requiring a judicial warrant to make immigration arrests inside such facilities.
Immigration and Customs Enforcement agents made the arrests Tuesday at Sonoma County Superior Court, prompting an outcry from criminal justice and court officials who said the action undermines local authority and deters immigrants who are in the country illegally from participating in the U.S. justice system.
ICE said Californias law doesnt supersede federal law and will not govern the conduct of federal officers acting pursuant to duly-enacted laws passed by Congress that provide the authority to make administrative arrests of removable aliens inside the United States.
Our officers will not have their hands tied by sanctuary rules when enforcing immigration laws to remove criminal aliens from our communities, David Jennings, ICEs field office director in San Francisco, said in the statement.

(17,873 posts)ICE agents have every right to arrest wanted immigrants, no matter where they are, whether in a state, city or county building.
Any local interfering with a lawful arrest will find themselves being arrested themselves and federally prosecuted.
It sucks, but it's just the way it is.

(966 posts)ICE people have to pass thru a screening to enter, like all others. It is in the authority of local authorities to require that they remove all weapons, badges, etc. and then to display their identities to be checked.
This could take an hour or more; meanwhile they are detained.

(966 posts)This is a privilege given, but not in any laws. Or any authority that ICE commands.
Here in Worcester I saw 2 ICE guys--one sort of in plain clothes, the other in camouflage regalia--asked to stand aside while others went through the detector machines at the courthouse.
They were prevented from entering until they displayed their weapons. It took about 40 minutes!
With a little tweaking, it could take 2 hours.

(17,873 posts)The vast majority of LEO's will give professional courtesy to other LEO's, whether Federal, State or Local.
I know this because much of my family were in Law Enforcement.

Also, if an ICE agent saw an undocumented worker that was wanted in a state courthouse, you can bet the farm that the local LEO's aren't going to prevent them from making an arrest, if they did interfere, they would be arrested for obstructing a Federal Agent in the lawful performance of their duties and would probably be Federally prosecuted in Federal Court.

2) Stop all persons who do not have immediate, direct, or specific purposes for coming inside of a court house... you'all have cameras, metal detectors, and additional security measures... use them vigorously, smile, walk them through all that stuff and more...for security, 'cause after all armed persons have killed city, county, state and federal level personnel before. Refuse their entrance unless and until they meet your level of security is assured.. e.g. no guns, no shields, no absolutely no jackboots.
3) Every time and in every situation where a 'jackboot' acts should be filmed with speakers/recorders on and pixels high... complete, steady, unwavering, and full.

Nothing a state can really do to stop ICE from doing their own work but they can refuse to in state cooperation.
The AP title implies that feds are somehow bound by state laws and that ICE overstepped.
