Judge orders Hillary Clinton deposition in email flap
Source: POLITICO
A federal judge has ordered former Secretary of State Hillary Clinton to sit for a sworn deposition for the first time in connection with her use of a private email account during her State Department tenure. U.S. District Court Royce Lamberth issued the order Monday in connection with a five-and-a-half-year-old Freedom of Information Act lawsuit the conservative group Judicial Watch filed seeking emails related to the deadly 2012 attack on U.S. facilities in Benghazi, Libya. Clinton was previously required to submit a sworn written statement about her email use, but the deposition—if it takes place—would be the first time she has had to submit to live questioning under oath on the subject. During her four years in President Barack Obama's Cabinet, Clinton relied on a private email account and server for both her work-related and personal messages. The practice led to a storm of controversy that roiled her 2016 presidential bid and is widely viewed as contributing to her ultimate defeat by Donald Trump. In response to press questions during the campaign and in the sworn statement, Clinton said she kept the private account and server after taking over as secretary of state in 2009 as a matter of convenience and not to avoid FOIA or other disclosure requirements. The FBI investigated, interviewed Clinton and recommended against criminal charges, but it did find dozens of messages in her account that officials said contained highly classified information. However, Lamberth said in his ruling Monday that the FBI probe and representations by the State Department have not adequately put to rest questions about the episode and Clinton's deposition is needed to address those concerns. 36. clearly political
all questions have been answered. JW is using the courts for political purposes, not to seek justice. This is vexatious litigation, and this is the grounds HC has to appeal on. She is now a private person. She can now turn around and sue them, and get a pre trial discovery. Which would expose the fact that JW is a wing of the GOP.

55. In won't work as long as Democrats nominate judges who respect the rule of law.
We've spent generations defending and supporting the independence of the judicial branch.
Retrumplicans have spent generations turning the court into just one more branch of government that should be a weapon of partisan power. It wouldn't matter to have a Left Judicial Watch, because this judge would look at two identical cases and order a deposition for Democrats, and dismiss a request for deposition from a Retrumplican. And you know what? The Retrumplicans aren't even bothering to try to hide it anymore. The Retrumplicans and their MAGAt voters would cheer making being a Democrat a criminal act!. They are so far up to their eyeballs in illegal and corrupt crap that they will kill people in the streets to prevent their crimes from seeing the light of day. Mark my words. Using the "courts" and foreign governments to pursue criminal investigations of their political enemies is JUST THE START. |

22. This is actually kind of terrifying for a couple of reasons.
First, Royce Lamberth is long time partisan Republican activist. He has long used his position to help Republican politicians and to hurt Democrats.
Second, it is absurd that a right wing organization like Judicial Watch could be given standing in this matter, much less the right to depose a former Secretary of State. Royce Lamberth, like William Barr, is properly identified as a fascist. I hope this decision can be appealed. It is an absurd legal ruling. |

According to Wikipedia, J. Royce Lambeth is a "visiting judge in San Antonio for several months per year." I hope Secretary Clinton appeals. And if that doesn't get a good result, appeal again. Delay until after November. Which we all hope will change everything.
