DOJ asks Supreme Court to block Democrats' access to Mueller documents

The Department of Justice (DOJ) on Monday asked the Supreme Court to overturn a lower court decision granting House Democrats access to redacted grand jury materials from former special counsel Robert Muellers Russia probe.
The Monday filing serves as the Trump administrations formal appeal of a March order to hand over secret transcripts and exhibits that Democratic leaders of the House Judiciary Committee initially sought as part of the impeachment inquiry into President Trump.
The justices previously granted the administrations request to halt the disclosure order, issued by a divided three-judge panel of the D.C. Circuit Court of Appeals, from taking effect to allow time for an appeal.
In its filing, DOJ lawyers urged the justices to take up the case and to prevent an unwarranted breach of grand jury secrecy.

(216 posts)Federal law profits turning over grand jury testimony and materials to anyone, including Congress, except for a few exceptions. The Supreme Court has rules that for the most part, federal district court judges have no power to order it to be done.
The exception most often used is that of a current criminal prosecution. Impeachment has been ruled an equivalent activity.
The legal question is whether an ongoing impeachment investigation includes one that is looking for unspecified crimes ( what would be a fishing expedition). Whether the House has exhausted all other means to get the same information. Failing to have even issued subpoenas for most of the relevant witnesses or carrying through with efforts to enforce those they did issue, was the equivalent of ending the preparation for charges and trial.
Given the legal prohibition and some murkiness around whether what is presented as an impeachment is sufficient under the current circumstances and prior precedent, most careful Attorneys General might do the same thing.

(23,097 posts)Kavanaugh has to be impeached, but that part will be relatively easy because he's guilty as hell, if Dems retake the Senate and don't allow any filibusters. Until then, SCOTUS is our enemy, as much as drumpf and PUtin. Roberts will sometimes vote correctly on social issues, but on anything really important to the rich or right wing, he ALWAYS votes their way and will not protect our constitution one bit.
