Flynn fires back at 'partisan assault' by ex-judge, says court must dismiss his conviction

Michael Flynn’s attorneys accused a court-appointed adviser Wednesday of launching a “flagrant personal and partisan assault” against him, President Trump and Attorney General William P. Barr in the ongoing battle over whether a judge should immediately dismiss Flynn’s conviction for lying to the FBI.

Flynn’s defense in court filings blasted former New York federal judge John Gleeson’s opposition to the Justice Department’s move to dismiss the case as a “wrap-up smear,” an “affront to the Rule of Law” and a “raging insult to the citizens of this country” who view Flynn’s prosecution as a corrupt political prosecution.

“The irony and sheer duplicity of [Gleeson’s] accusations against the Justice Department now — which is finally exposing the truth — is stunning,” Flynn attorneys wrote in a 32-page brief.

They said courts cannot “usurp or even inquire behind” the executive branch’s core power of deciding who to prosecute — such as by calling witnesses or seeking new evidence in Flynn’s case — and can only review the existing record.

You pled guilty - not once, but twice!! The next step is sentencing. There's no mulligan here - you can't just take it back because Trump's lackey decided to void the charges after the fact. In what court in this country has that happened ever??? Man up and do your time.

If this got reversed now, what would that say about the principle of "equal protection under the law" to the thousands of incarcerated folk currently serving time? Talk about a "snowflake".

We have to change this pathetic situation with a sweep of the WH, House, and the Senate in November - crush these MFer’s into dust, and institute a government for the people rather than the .01%.

If trump has his way the president will be pretty much untouchable in a court of law. There s nothing he won't be able to and walk away with complete impunity.

When the attorney does not cite case law on the issue. That tells you everything you need to know. I would not think Flynn has legal recourse until after sentencing, when he could appeal the sentence. Like the Judge said, Flynn either lied under oath to the FBI or he lied under oath to the courts when he said he lied to the FBI. How can that equal to not guilty. I know, he is claiming entrapment by the FBI but nobody forced him to lie. He thought it was to his advantage to lie and he got caught.

Then when trump is ousted he can be retried and convicted with new charges for him and others close to him this time. He committed perjury again, and the charges they had dropped before can be started again. Flynn and his lawyers are making a huge mistake. Flynn and others close to him will go to prison.

Ford pardoned Nixon without any charges. Ford and Carter pardoned draft evaders without charges or convictions. Clinton pardoned Marc Rich, who was a international fugitive at the time, and had not faced trial on his charges. Just a few examples.

Whatever happens with Flynn this will be the last of it. There will be no re-trial.
