Geoffrey Berman reverses course -- now says he will leave SDNY 'effective immediately'

The question of who is leading the DOJ’s Southern District of New York appeared to be settled on Saturday after Georffrey Berman announced he would be immediately vacating his position.

There was a question as to whether he had been legally fired after Donald Trump disputed AG Bill Barr’s claims that the president had fired Berman.

“In light of A. G. Barr’s decision to respect the normal operation of law and have Deputy U.S. Attorney Audrey Strauss become Acting U.S. Attorney, I will be leaving the U.S. Attorney’s Office for the Southern District of New York, effective immediately,” Berman said in a statement released Saturday.

Originally AG Sessions appointed Berman to the job on a temporary 120 day basis. At the end of that period the SDNY judges used a provision in the U.S. code to appoint Berman on an interim basis until the vacancy was filled.

They wanted Jay Clayton there for a reason. If Acting AG holds firm, they'd have to nominate and get approval for Clayton to take over.

It was only after Berman said he wasn't leaving that the whole issue of firing came up. They offered to move Berman to DOJ to be head of Civil Division. He declined.

Barr assumed he had total control over Berman and said he was leaving the position. Berman said no. Barr said you're fired. Berman said, you can't fire me cuz I was appointed by judges. Barr said Trump asked me to fire you. Trump said I'm not involved this was Barr's decision. Berman says I'll step down but you have to appoint my asst. Deputy, not Clayton, as acting AG. Now they can only remove her for cause or if they nominate and confirm someone to take the position.

I think knowing he had a good Deputy AG to step in &the fact he can now testify in Congress are the 2 motivations, also knowing the severed relationship was going to be untenable & difficult working w Lowbarr.

He made his point. He HAD to leave. Not much else he could do.

More who are TOLD to step down (when they don't think it is proper) should do as he did. Make them show how much they hate democracy.

"Subpoena Barr rather than "inviting" him to testify - which he refuses to do every time. If he refuses, arrest him for inherent contempt (House has this power.) Lock him up in the jail cell in the Capitol Building that is there for exactly this reason", said Kurt Eichenwald in a tweet.

would not leave office. Berman will testify in the House on Wednesday. I've heard that Barr has been "invited." What if ... the invitation turns into a subpoena and based on (unreported) conversations Pelosi and the House has had with Berman, the House will order the arrest of Barr if he does not show up?

Barr is a scumbag who lies as much as Trump does. Audrey Strauss is Acting Attorney and Trump can quickly name the SEC guy to be approved by the Senate, and then two of the top SDNY people are gone. Insure hope there are backup files off site somewhere that Barr can’t have them destroyed. I wish Berman had taken his case to the court that appointed him.

Would keep his word the deputy AG would step in &continue the inestigations he was working on. I think this was a smart move on Berman's part.

He or his family was probably threatened. Remember this is trump, he's desperate enough to do this... someone, a stranger, walks up to him and says something. leaves something on his doorstep or his car windshield, anything. Remember the US Ambassador, trump was caught on tape telling someone to "take her out!" Of course it was reinterpreted as a firing, but we all know what he meant.
