Trump says he's 'authorized' arrest of anyone 'who vandalizes or destroys' monuments

President Donald Trump said he "authorized" the federal government to "arrest anyone who vandalizes or destroys any monument, statue or other such Federal property in the U.S."
Trump also wrote the offense would be punishable with up to 10 years in prison.

"This action is taken effective immediately, but may also be used retroactively for destruction or vandalism already caused. There will be no exceptions!" he wrote on Twitter on Tuesday morning.

Trump cited the Veterans Memorial Preservation or "such other laws that may be pertinent" to enforce the arrests.
One section of the act states that a person who willfully injures or destroys veteran memorials -- or attempts to do so -- shall be fined and/or imprisoned no more than 10 years.

President Trump still does not understand that he does not make the law. I do know that it's illegal to vandalize monuments. I do not know what the actual punishment is upon conviction, but I doubt it's 10 years.

If any person shall willfully destroy, mutilate, deface, injure, or remove any monument, column, statue, memorial structure, or work of art that shall be erected or placed upon the grounds of the battlefield by lawful authority, or shall willfully destroy or remove any fence, railing, inclosure, or other work for the protection or ornament of said battlefield, or any portion thereof; or shall willfully destroy, cut, hack, bark, break down, or otherwise injure any tree, bush, or shrubbery that may be growing upon said battlefield, or shall cut down or fell or remove any timber, battle relic, tree, or trees growing or being upon such battlefield, except by permission of the Secretary of the Interior, or shall willfully remove or destroy any breastworks, earthworks, walls, or other defenses or shelter, or any part thereof, constructed by the armies formerly engaged in the battle on the lands or approaches to the battlefield, any person so offending shall be guilty of a misdemeanor, and upon conviction thereof before any court of competent jurisdiction, shall for each and every such offense be fined not less than $5 nor more than $100.

§1369. Destruction of veterans' memorials
(a) Whoever, in a circumstance described in subsection (b), willfully injures or destroys, or attempts to injure or destroy, any structure, plaque, statue, or other monument on public property commemorating the service of any person or persons in the armed forces of the United States shall be fined under this title, imprisoned not more than 10 years, or both.
(b) A circumstance described in this subsection is that
(1) in committing the offense described in subsection (a), the defendant travels or causes another to travel in interstate or foreign commerce, or uses the mail or an instrumentality of interstate or foreign commerce; or
(2) the structure, plaque, statue, or other monument described in subsection (a) is located on property owned by, or under the jurisdiction of, the Federal Government.

Short Title of 2003 Amendment
Pub. L. 10829, §1, May 29, 2003, 117 Stat. 772, provided that: "This Act [enacting this section and provisions set out as a note under section 109 of Title 23, Highways] may be cited as the 'Veterans' Memorial Preservation and Recognition Act of 2003'."
