Judge temporarily blocks tell-all book by Trump's niece

A tell-all book by President Donald Trump’s niece cannot be published until a judge decides the merits of claims by the president’s brother that its publication would violate a pact among family members, a judge said Tuesday.

New York state Supreme Court Judge Hal B. Greenwald in Poughkeepsie, New York, issued an order requiring the niece, Mary Trump, and her publisher to explain why they should not be blocked from publishing the book: “Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man.” A hearing was set for July 10.

The book, scheduled to be published July 28, was written by Mary Trump, the daughter of Fred Trump Jr., the president’s elder brother, who died in 1981. An online description of it says it reveals “a nightmare of traumas, destructive relationships, and a tragic combination of neglect and abuse.”

The judge banned “publishing, printing or distributing any book or any portions thereof” before he decides the validity of Robert S. Trump’s claims.

This won’t stop the publication most likely. Judge just crossing the t’s and dotting the i’s.

The only reason I can think that the judge would place the burden of explaining why on the author would be if someone has produced an agreement signed by Mary Trump that no book would be published.

The Court signed an Order to Show Cause. That’s simply a routine legal mechanism by which the party initiating a legal action can get a preliminary injunction to preserve the status quo ante pending the disposition of the proceeding. It’s hardly nefarious and not a big deal.

Courts frown on prior restraints, and the the Fred Trump’s chance of getting a permanent injunction faces an uphill battle. The NYS Supreme Court (trial level court in NY) is likely to say that the book can be published, but the author can face another lawsuit based on the breach of the NDA and slander, if any, and can seek to recover consequential damages, if there are any. But this proceeding is about delaying publication until after the election. Expect the Trumps to obstruct, delay and appeal as often they can.

was stolen (which it was) and could be classified. (And even that had to be allowed to be published.)

A woman's life story isn't stolen and isn't classified. Who knows what this NDA even says or if it's at all enforceable (a lot of NDAs are not enforceable, as Trump himself has learned).

Worse comes to worst, she can go Bolton's route, and release the book to reviewers who read parts of it aloud.

Still waiting to find out if a NDA trumps Mary's 1st Amendment rights to publish. It certainly can't be libel or slander if it's true, right?

to overtake democratic values. Courts, if they're going to be viable supporters of rule of law, have to separate human constitutional rights from corporate proprietary secrets.

Mary Trump needs to go to a foreign publisher to get the book published if the judge says she can’t proceed. Her lawyer will appeal, and meanwhile a foreign publisher can release it to the world. I suspect a British or German or French publisher would be happy to do this. I imagine Simon & Shuster could negotiate a deal with a foreign company if they, or their parent company Viacom do not already own one.

I am wondering why her earned title is neither on the. Book, nor in any articles about her.
