US Supreme Court allows SC vote-by-mail restriction to proceed

By Ariane de Vogue, CNN Supreme Court Reporter

(CNN) -- The Supreme Court on Monday granted a request from South Carolina Republicans to reinstate the state's witness-signature requirement on absentee ballots pending appeal.

The court's order on the first day of its new term is a loss for the Democratic National Committee. There were no noted dissents.

The court said, however, that any ballots cast before it had acted, and received within two days of the order, cannot be rejected for failing to comply with the witness requirement. Justices Clarence Thomas, Samuel Alito and Neil Gorsuch indicated they would not have counted those ballots.

"This sends a strong signal that the Supreme Court is going to be wary of federal court-ordered changes close to the election, even those done to deal with burdens on voters created by the pandemic," said election law expert Rick Hasen, who serves as a CNN election law analyst.

Thomas, Gorsuch, and Alito would let SC nullify those ballots. https://supremecourt.gov/opinions/20pdf/20a55_dc8e.pdf

Start with 4 twenty-something year old, liberal recent law school grads. (They can't be any LESS qualified than Kavadrunk..)
That will be a 7-6 majority.
Then in year 2 add 4 more ultra liberals. Then expand the lower courts by 1000.

Fuck these Repigs to all hell for trying to turn America into a theocracy.

Thank you for posting this. It's extremely important. We have to win the elections, then add to the USSC.

There weren't any listed liberal dissents... and three of the conservatives dissented on one part of the order.

Elections have consequences. When the voters elect stupid people you get stupid laws and this law is stupid because it serves no useful purpose. The remedy is to elect enlightened lawmakers. Kavanaugh, Roberts and the liberals were right to count the early votes as I see no legal way to nullify those early ballots. Another legal thing they could have possibly done is to declare those ballots provisional and notify the voter to come in and correct the problem but they didn't do that.

The repub party does all it can to make sure folks can't vote. Are Americans blind to what they are doing? Don't any of them see how unfair this is? I just don't get how they think this is fair. Are any of them turned off?

SCOTUS has said that the Constitution's granted fairly broad authority to states to conduct their voting.

I don't see that the law as written has any racial or discriminatory bias.

Rather than do what many think is bad--change the rules close to elections (which apparently only applies to things they don't like, certainly not to the changes they prefer)--I think the basis lies elsewhere.

Might read the opinion to see if it says anything relevant.
