Poland's Top Court Rules Out Abortions Due To Fetal Defects

WARSAW, Poland (AP) Polands top court ruled Thursday that a law allowing abortion of fetuses with congenital defects is unconstitutional, shutting a major loophole in the predominantly Catholic countrys abortion laws that are among the strictest in Europe.
Two judges in the 13-member Constitutional Court did not back the majority ruling. Activists deplored the decision, and the Council of Europes human rights commissioner wrote on Twitter that it was a sad day for womens rights.
Hours later, hundreds of protesters defied a pandemic-related ban on gatherings and staged a protest before the court with signs saying You Have Blood on Your Gowns and then walked to the offices of the main ruling conservative party, Law and Justice. The police were checking their documents.
The ruling party will soon propose new legislation to better support women, the partys spokeswoman said. The courts decision came in response to a motion from right-wing lawmakers who argued that terminating a pregnancy due to fetal defects the most common reason cited for legal abortions in Poland violates a constitutional provision that calls for protecting the life of every individual.

The law was introduced in 1993 by Polands young post-communist democracy, a hard-won compromise between the influential Catholic Church and the state authorities.
The law allowed abortions when a pregnancy endangers a womans health or life, or results from rape or other illegal act, and also in case of congenital defects. Only the last provision was challenged.
Many Polish women have sought abortions abroad, even before the new ruling.

(6,496 posts)Then it should have to care for them for their whole lives. Doubt that will happen though. Seriously, if life is so precious to them, then they should be willing to do that.

(27,811 posts)I have a cousin in Kentucky who carried a non-viable baby to term, who knows why (they knew it wouldn't live, but she and her family are uneducated, probably anti-abortion as well). She actually posted a photo of the baby, who lived for a few minutes. It was horrible. The proximate cause of death was probably the lack of a functioning brain, but this baby had teeth (a full set, for a newborn) outside of the face, three eyes, and a misplaced nose, among other things. I'm sorry if that's an upsetting image, but that's the reality of what I saw. In a fair world, my cousin would have mercifully ended the pregnancy, but I think that in her circles, there is stigma attached to abortion. It was awful, just awful.

(6,261 posts)I think about half of all pregnancies end in miscarriages anyway, often because of fetal abnormalities like that. If you're consistent in your religious beliefs, you must also believe God is the biggest abortionist out there.
But, as I said, I can't relate to their mindset.
