(CNN)A federal appeals court ruled Thursday that mailed-in ballots in Minnesota must be received by elections officials no later than Election Day.
The 2-1 ruling -- a win for the Republican challengers to the state's plans -- cuts off a weeklong window after Election Day where state officials had planned to receive ballots that had lingered in the mail. The court found the Minnesota secretary of state's accommodation went against a state law that said ballots delivered by mail to elections officials after 8 p.m. on Election Day should be marked late.
"The Secretary's instructions to count mail-in ballots received up to seven days after Election Day stand in direct contradiction to Minnesota election law governing presidential elections," the ruling stated.

"The consequences of this order are not lost on us," the court's opinion said. "We acknowledge and understand the concerns over voter confusion, election administration issues, and public confidence in the election. ... With that said, we conclude the challenges that will stem from this ruling are preferable to a postelection scenario where mail-in votes, received after the statutory deadline, are either intermingled with ballots received on time or invalidated without prior warning."

Republicans are challenging Minnesotas plan to accept mail-in ballots up to a week after Election Day as long as theyre postmarked by Nov. 3 -- an extension the state put in place to account for an expected flood of absentee voting during the pandemic.
The decision Thursday by the U.S. Court of Appeals in St. Louis is a setback for Democrats, whose nationwide effort to ensure ballots mailed by Election Day get counted has had mixed success, including at the U.S. Supreme Court.
Late-arriving ballots must be removed from vote totals in the event a final order is entered by a court of competent jurisdiction determining such votes to be invalid or unlawfully counted, the court said in a 2-1 decision.

I monitor Minnesota Public Radio's news website and the CBS and the ABC local affiliates website every damn night. All 3 every damn night. And I looked at the Secretary of State website many times and seen that.
Those of us who have been following things knew this might not turn out to be the case, but 90% of regular people in MN aren't political junkies that follow all the ins and outs of all this crap. We generally believe what we're told when it comes from authoritative sources. I know I know ...

The pattern were seeing here is making it increasingly clear that if there is a Democratic majority in the Senate to go with that in the House, they need to seriously think about dramatically changing the courts. Including taking jurisdiction away.

Seems like this ruling has to come from a State court, not Federal.

(2,227 posts)to challenge the results as rigged. They know for his scheme to be effective, they need to vote in person on election day. Many states can't start counting mail-in votes until election day, some can't start until after the polls are closed.
Since Democrats are primarily the ones voting by mail, mail-in votes that are postmarked on/by election day, but have been purposely delayed by DeJoy and not received by election offices, at the instruction of the turd, won't get counted in time.
They are slick motherfuckers.
Suits should be filed in every state affected, that CLARIFIES that the turd PURPOSELY fucked with the mail delivery, by hand picking Louis DeJoy to carry out his election obstruction (who should GO TO JAIL for it), making it impossible to be sure every vote that was legally cast and postmarked on or by election day (using the same guidelines as in-person voting) be counted.
The courts should require EVERY VOTE POSTMARKED ON OR BEFORE ELECTION DAY be counted, no matter the date the election offices receive them. The delay was not due, in any way, to action by the voter, but WAS due to purposeful and deliberate road blocks set up by the turd and DeJoy.
THEN start arresting every person who participated in this scheme of election obstruction.
That would at least be a START in dealing with this organized and prearranged clusterfuck.
