Trump lawyer details far-fetched strategy to reverse Pennsylvania win for Biden

A lawyer for President Donald Trump's campaign on Wednesday revealed that the campaign could be relying on pulling off a complicated and possibly unprecedented legal and legislative trick shot to undo President-elect Joe Biden's victory in Pennsylvania and possibly in other states.
That far-fetched strategy would require a federal court to invalidate Pennsylvania's certification of its election results, and then get the state's General Assembly to agree to send Trump electors to the Electoral College.
The idea is buried in a footnote in a three-page letter that campaign attorney Marc Scaringi wrote to the U.S. Court of Appeals for the 3rd Circuit.
The Trump campaign is asking that appeals court to hear its bid to block the effect of Tuesday's certification of a win for Biden in Pennsylvania.

(26,044 posts)...according to right-wing logic, the legislature could submit its own, ad hoc slate of Trump electors, and the SCOTUS could then rule that the Constitution specifically authorizes "state legislatures" to decide how electors are to be appointed, and that therefore the Trump slate must be the one accepted.
Not likely to work, but it would be a real shit-show, because you'd get two sets of electoral votes from PA (etc.) showing up, with two resulting "final electoral college tallies," one giving Biden 306 EV and the other giving Trump 270+, and Congress might decide to blow off the SCOTUS ruling, since there's nothing in the Constitution giving the judiciary any authority in determining electors. (Incidentally, since it would be a matter of competing totals, and not a failure of either candidate to get a majority, it wouldn't be decided by the House state delegations, either. In short, we'd have a full-blown constitutional crisis, and likely a second civil war.)

(15,265 posts)challenge to Act 77 that expanded absentee ballot voting. A law that was passed by the GOP-controlled state legislature and was in effect for the April-moved-to-June primary with no objection from either candidate.
It won't affect the presidential certification, but the state was injoined from certifying any uncertified down ballot elections.
The judge issuing the order was an R, Patricia McCullough. Unfortunately she won her 10 year retention election in 2019, so no chance to dump her until 2029.
