Trump administration seeks to undo decades-long rules on discrimination

The Trump administration is pushing in its final days to undo decades-long protections against discrimination, a last-ditch effort to accomplish a longtime goal of conservative legal activists.

The Justice Department is seeking to change interpretation of Title VI of the 1964 Civil Rights Act, which bars discrimination on the basis of race, color or national origin by recipients of federal funding. Under these rules, actions are considered discriminatory if they have a discriminatory effect, what’s known as a “disparate impact,” on protected groups. Under the new version, only intentional discrimination would be prohibited.

The Trump administration has been considering this change for more than two years but waited until its final weeks to try to put it into effect. A notice about the change was filed for regulatory review at the White House last month and a copy of the proposal was shared with The Washington Post.

The document says the change would “provide much needed clarity to the courts and federal funding recipients and beneficiaries,” noting that the Justice Department currently distributes about $6 billion a year in grants or awards, though it also concedes it is unclear what portion of that might be affected by the planned change. The planned change was pushed in late December by William P. Barr, one of his last acts as attorney general. A Justice Department spokeswoman declined to comment.

getting the damn vaccine production up with a realistic logistical plan for distribution.

All Presidents do this at the end - they call them "Midnight Regulations".

However when Obama left office and did his flurry of executive actions, and the GOP controlled both chambers of congress, they invoked the Congressional Review Act of 1996 to kill a number of Obama's initiatives right off the bat by a simple majority vote on simple legislation.

So it's entirely possible, if we are lucky tonight, that we can do the same thing. It would probably be easier doing it that way than having to fine-tooth comb through whatever nonsense they are putting in place right now, and trying to reverse it (it's not as simple as just ripping it up and starting over unfortunately - I think there has to be an in depth justification done to establish why the rule should be repealed).

As a note - DACA was done that way - as an Executive Order that this administration attempted to repeal - and the repeal was reversed and the E.O. upheld in court, including the SCOTUS, because the administration couldn't come up with a satisfactory justification for why it should be repealed.

The vaccine distribution is a failure. I know that it will be a priority for Biden.

the legislature to be made into laws.

I realize this won't be the end of the problem - the corporate fascists will go running to the courts, now well populated by trump-appointed rwnjs - but we'll just have to keep fighting until we wrest control of our country and our laws from the fascists and oligarchs.
