Man known as 'QAnon Shaman' asks Trump for pardon after storming Capitol

A man who donned fur, horns and red, white and blue face paint while storming the Capitol last week is now requesting a pardon from President Trump.

Jacob Anthony Chansley, who also goes by the name “QAnon Shaman," turned himself in to authorities Saturday after he traveled to Washington, D.C., at Trump's call for "patriots" to take a stand against the election results.

His attorney Albert Watkins is now making a plea for a pardon, stating that Chansley was not involved in Wednesday's violence and surrendered peacefully.

“My client had heard the oft-repeated words of President Trump,” Watkins said, according to local CBS station KMOV4. “The words and invitation of a president are supposed to mean something. Given the peaceful and compliant fashion in which Mr. Chansley comported himself, it would be appropriate and honorable for the president to pardon Mr. Chansley and other like-minded, peaceful individuals who accepted the president’s invitation with honorable intentions.”

The buffoon's lawyers will understand this guy is placing all the blame on him, that will make the buffoon react negatively so my bet is that the "peaceful" protester will not get a pardon because he just made the case for final impeachment and future indictments much better for the prosecution..."He told me to do it!"

The president is unable to pardon himself or anyone else involved in the action that caused him to be impeached.

Trump can't do anything now to save his followers that got arrested. You'd think when his people claim to be so dedicated to the constitution, they'd know that.

Oh well. Eventually that organic food option is going to wear out, too. It is a pleasantry right now. After the Shaman is convicted, he is going to have a hard time convincing any judge he deserves anything not standard issue.

In the United States, the pardon power for offenses against the United States is granted to the President of the United States under Article II, Section 2 of the United States Constitution which states that the President "shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment".

to pardon anyone that has convictions tied to the action that got him impeached. He could pardon them if they committed any other crime, but since they were involved in a riot he inspired, he is unable to pardon them.

............Chansley is facing charges including knowingly entering or remaining in any restricted building or grounds without lawful authority, and violent entry and disorderly conduct on Capitol grounds.



In the days following the riot, Chansley told NBC News that he did not see anything wrong with his actions.

"The fact that we had a bunch of our traitors in office hunker down, put on their gas masks and retreat into their underground bunker, I consider that a win," he said, referring to the lawmakers inside the building who had to take shelter.

Earlier this week, Chansley reportedly refused to eat food given to him while in custody because it was not organic.

...ANYONE to the United State Capitol Building. That building complex is the property of the people and is administered and occupied by the FIRST BRANCH OF GOVERNMENT, the Legislative. tRump* has ZERO authority over the Capitol... and he KNEW THIS when he encouraged #domesticterrorists to riot and overtake the building. Even tRump* cannot formally enter the Capitol without and invitation and permission from Congress.

Article 2, section 2 of the US Constitution:


The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.


This is vague. It may mean Trump can't use his pardon power now, after he's been impeached. My understanding is that the meaning of this clause has never been ruled on in court. And it's not likely to be ruled on in the next 5 days. So there's doubt. It's not clear whether pardons granted by Trump are valid at this time, so even if Chansley et al get such pardons, the pardons may not be valid.

I'm hoping this doubt is enough to stop Trump's spree of buying illegal behavior in his last days in office.

is "except at times when an impeachment is happening." That would mean the time between Congress's vote for impeachment and the Senate's action on it.

I admit that other interpretations are possible.

But now, Trump has been impeached and the Senate has not yet acted, and is not likely to act before his term is over. So any pardon he issues is under a cloud, because a court may interpret the impeachment clause to mean that he can't issue pardons now.

Trump's first impeachment case was over when the Senate acquitted him.

Can Trump give a pardon? While Presidential pardon power otherwise may be absolute, pardoning a co-conspirator seems akin to pardoning oneself, and while Trump can try that, the likelihood that his self-pardon will survive judicial scrutiny is thin. I doubt that there could be any precedent or scholarly examination of the ability to pardon co-conspirators, which once was only fodder for a hypothetical on a law school exam.
