Lawmakers who interacted with the pro-Trump protesters who rioted at the Capitol last week could face criminal charges and will almost certainly come under close scrutiny in the burgeoning federal investigation into the assault, former prosecutors said.
This is incredibly serious, said Ron Machen, a former U.S. attorney for Washington, D.C. Although you would need compelling evidence before charging a member of Congress with anything related to the breach of the Capitol that day, this has to be investigated.
Unlike with the president, theres no Justice Department policy shielding members of Congress from legal accountability while in office.
Id say those are potentially viable prosecutions, added Peter Zeidenberg, another former federal prosecutor in Washington. Id say those guys should be worried.
The role members of Congress may have played in facilitating the deadly attack drew intense attention this week after Democratic lawmakers alleged that some of their Republican colleagues facilitated tours of the Capitol on January 5 one day before demonstrators engaged in the assault that terrorized lawmakers, ransacked congressional offices and left as many as five people dead.

Why would the evidence need to be any more compelling than the evidence needed to investigate charge the 100+ that have already been charged.
Several reps have already reported that other reps gave recon tours. That seems to be worthy of investigating, without the mealy mouthed conditions alluded to.

(13,003 posts)will, in the future, find out just why it was so important for the RepubliCONs to quite literally pack the Appellate courts with their RepubliCON loyalists for the past 20 years. Hell, look at the Number Mitch has shoved thru in just the past four years under Trump...
AND, if the RepubliCON Judge fails them, there is always the supreme court!!!!!! LOL

(77,316 posts)I heard on morning news that all tours of the Capitol were banned prior to this due to Covid, so these tours that were given by these reps violated the ban to start with. However, proving there was intentional malicious purposes for the tours may be hard to prove???
I don't doubt there's anything that treasonous bunch wouldn't do.
Botany
(77,316 posts)...day prior to Trump's attempted coup and then those same people in the Capitol the next day during the attack
you got them. Especially if you had multiple Congresspersons doing the exact same thing because that might show
a conspiracy to overthrow the legally elected government.

are thoroughly investigated and possibly charged if it is found that they gave information to the insurrection mob, like maps and if they pointed out Democrats offices and where Pence would be.

They have 5 minutes to decide if we amend the indictment to include the 5 death penalty cases or not. You give the highest person on the food chain.
If you do, then your recommended sentence will be 25 to life. Otherwise, we'll book your passage to terre haute and death row.

(15,359 posts)They may even gladly hand over that information expecting them to save them somehow or use it as a defense. They probably thought those lawmakers would be heroes when they took over the government and expected to be successful. The lawmakers denying knowing them and any involvement, will be more likely to make them testify against them.

The extent of the demonstrations, in an almost ironic way, gives me more belief that the 2016 election was not stolen. Trump just motivated every last non-voting idiot in every dead-end town to vote, and here they are.
In my mind this is the biggest event since the JFK assassination, and surely more widespread.
