Rudy Giuliani Sued by Dominion Voting Systems Over False Election Claims
Source: NY Times
Dominion Voting Systems filed a defamation lawsuit on Monday against Rudolph W. Giuliani, the lawyer for Donald J. Trump and former mayor of New York City who played a key role in the former presidents monthslong effort to subvert the 2020 election.
The 107-page lawsuit, filed in the Federal District Court in Washington, accuses Mr. Giuliani of carrying out a viral disinformation campaign about Dominion made up of demonstrably false allegations, in part to enrich himself through legal fees and his podcast.
The suit seeks damages of more than $1.3 billion and is based on more than 50 statements Mr. Giuliani made at legislative hearings, on Twitter, on his podcast and in the conservative news media, where he spun a fictitious narrative of a plot by one of the biggest voting machine manufacturers in the country to flip votes to President Biden.
Mr. Giuliani, one of Mr. Trumps closest advisers and confidants, has faced continuing fallout for his highly visible efforts to reverse the election outcome. This month, the chairman of the New York State Senates judiciary committee formally requested that the state court system strip Mr. Giuliani of his law license.

That would, I think, constitute a deprivation of a litigant's rights.

(4,473 posts)Are they like Dean Wormer's "double secret probation" from Animal House?
There was a scam perpetrated in the English "South Sea Bubble" of 1720. People were investing in all sorts of wild financial schemes -- one, for example, to make square cannonballs and cannons to fire them. The scam I am thinking of was a company, "For carrying-on an undertaking of great advantage but no-one to know what it is!!" In one day, the con man collected £2000 (in 1720 pounds), closed up shop and departed for France. Are these pardons to be "of great advantage" to the criminal, but no one is to know that he got one?

This suit is meant to crush Giuliani and take everything he owns, including the socks he's wearing when the judgement comes down.
Which is a good thing.
Also, let's not forget about disbarment.

A legal advocacy group called Thursday for Rudy Giuliani to be investigated and potentially lose his license to practice law, filing an ethics complaint against the attorney with the Grievance Committee of the New York State Bar after the former New York City mayor led former President Donald Trumps legal campaign to overturn the election and pushed baseless election fraud claims.
Key Facts
The 18-page ethics complaint filed by the group Lawyers Defending American Democracy says Giuliani should be sanctioned immediately while the Committee investigates, including an interim suspension of his license.
The complaint alleges Giuliani knowingly propagated a false narrative of election fraud as the lead attorney in Trumps legal effort to contest the election results, including claims made in court and in public appearances, such as the rally immediately before the attack on the U.S. Capitol building where Giuliani called for trial by combat.
The attorneys allege Giuliani knew his claims were false, writing, A lawyer who lies to the public and abuses the court system to undermine democracy and the rule of law is not fit to practice law.

(34,136 posts)Than in many states. That's OK - Giuliani can keep his license long enough to represent Trump in his impeachment trial. Though since Giuliani should be considered a co-conspirator, I'm not sure he should.

(38,556 posts)I checked out what the dopes on the RW side of this tale have to say, and I know I'm not supposed to repeat it--so I won't.
But I will say that if Dominion thought for one minute that they didn't have a case (and since they are the plaintiffs they have the burden of proof) they wouldn't have bothered to file this. They would have skulked off into the sunset.
