Judge temporarily blocks Biden's plan to halt deportations

(CNN)A federal judge in Texas temporarily blocked the Biden administration's pause on deportations Tuesday, delivering a blow to one of the administration's first immigration actions.

The court order stems from a lawsuit filed by Texas Attorney General Ken Paxton challenging the 100-day pause on deportations, which took effect Friday. The complaint cited in part an agreement signed between the Department of Homeland Security and Texas in the waning days of the Trump presidency that required the department to consult the state before changing or modifying policies.

Judge Drew Tipton of the Southern District of Texas, however, said the temporary restraining order was appropriate under the Administrative Procedure Act. Tipton blocked the Biden administration from executing its deportation pause for 14 days.

I don't know what the ruling stated, but it must be a doosy of a read. Usually you block something to prevent further harm. This 180 degrees backwards.

The judge is allowing further harm to occur pending review.

This is just a temporary order while the judge gathers arguments and decides whether or not there's a case to hear.

It wouldn't be too unusual for the TRO to continue through the trial. That could be appealed, but the 5th circuit (above this judge) is (IIRC) 12/5 republican.

It will be interesting to see whether we get to a ruling before Biden's "pause" is set to expire in three months. Presumably, he would make a permanent determination by that point.

On February 4, 2020, his nomination was sent to the Senate. He was nominated to the seat vacated by Judge Sim Lake who took senior status on July 5, 2019.[4] A hearing on his nomination before the Senate Judiciary Committee was held on February 12, 2020.[5] On May 14, 2020, his nomination was reported out of committee by a 12–10 vote.[6] On June 3, 2020, the full United States Senate invoked cloture on his nomination by a vote of 53–42.[7] Later that same day, his nomination was confirmed by a vote of 52–41.[8] He received his judicial commission on June 15, 2020.
