Twist in Derek Chauvin trial: Prosecutors want jury selection put on hold

The murder trial of former Minneapolis police officer Derek Chauvin in the death of George Floyd kicked off Monday with prosecutors asking the judge to put jury selection on hold.
Before jury selection could begin on Monday, Chauvin's defense attorney, Eric Nelson, told the court that he will file a petition for the Minnesota Supreme Court to review a Court of Appeals decision issued on Friday asking that trial Judge Peter Cahill consider reinstating a third-degree murder charge against Chauvin.
State prosecutor Matthew Frank requested that Cahill delay jury selection in light of the defense petition regarding the additional charge.
"We won't know exactly what the charges are if we now go forward and start picking the jury," Frank argued. "So this court would be making decisions about jurors for a trial about which we don't know what the exact charges are going to be yet. And that jeopardy, once it attaches, that clearly cannot happen."

(415 posts)but how long are we going to have to be fortress Minneapolis before this thing is over? Granted, the boarded up high security zone is just downtown, but there's still an air of tension all over the city about this. Every police precinct is surrounded by a double layer of jersey barriers with 6 feet of chain link and a topping of barbed wire on top, with razor wire between the layers. All these delays just drag it out more and more.

But they want that because the defense has asked for a particular charge to be reinstated. How about framing the headline differently: On day jury selection is to begin, defense team creates delay by requesting reinstatement of murder charge.
I remember reading about the significance of this some time ago, but can't recall details.

their biggest regret about the floys murder is that chauvin was so stupid to let anyone film it so they have to say "that was terrible" (that he got filmed) but - cops are trained to do that with suspects like george floyd because he was a risk to go berserk due to his drug use....... etc
