Justice Department raises concerns with audit (Arizona)

The U.S. Department of Justice is asking Senate President Karen Fann to explain what steps shes taking to make sure the election audit she ordered doesnt violate federal laws prohibiting voter intimidation and requiring ballots be preserved.
In a letter to Fann on Wednesday, Pamela Karlan, the principal deputy assistant attorney general of the Justice Departments Civil Rights Division, said the department had two major concerns with the audit.
First, Karlan said federal law requires state and local election officials to safeguard and preserve election records. She expressed concern that Maricopa County election officials are no longer in control of ballots, election systems and other materials.
If the Senate designates someone else to serve as a custodian for election records, which must be maintained for 22 months, the Civil Rights Act of 1960 requires administrative procedures be in place giving election officers ultimate management authority over the retention and security of those election records, including the right to physically access them, Karlan wrote.

............In an April 29 letter, several voting rights organizations asked DOJs Civil Rights Division to send federal observers to monitor the audit. The letter raised both the issues that Karlan raised with Fann.
Ballots that are protected under federal law are in imminent danger of being stolen, defaced, or irretrievably damaged, and Arizona citizens are in imminent danger of being subject to unlawful voter intimidation as a result of flawed audit procedures, wrote representatives of the Brennan Center for Justice, Protect Democracy and the Leadership Conference.

(792 posts)It's bewildering that non-government, private actors were able to involve themselves to begin with. The next thing you know they'll not only be touching the ballots after the election, they'll be influencing where and how we vote.
And you know Ducey was up to something since he denied government security of the votes there to begin with. They are relying on right wing militia security to harass journalists entering the area.

(489 posts)they were just going on a "but mah freedums!" lark to the U.S. Capitol building, and who have awakened to serious federal criminal indictments and possible lengthy prison sentences if convicted, it's time for the Arizona frauditors and their ilk to look up from their idiotic search for bamboo fragments, and face some serious possible jail time for violations of federal civil rights and voters rights laws.
This, especially if there is any evidence whatsoever that ballots have been altered or mishandled. And I suspect that evidence won't be hard to uncover given the Republican ineptitude on a scale breath-taking to contemplate throughout this farce.

(36,424 posts)Why the delay? Everyday the stories coming out of AZ are worse & worse. Today, unattended ballots & computers. I don't think the dems are taking this seriously enough. We think because they can't overturn this election & that because they are a bunch of buffoons that nothing will come of this. This is the plan for all future elections in states where they lose. Only they won't wait for months until after the election has been certified, they'll be demanding to count the ballots the day after. This is about sowing chaos and pushing the limits of what they can do. We better wake the fuck up & start playing hardball. Someone needs to go to Manchin & ask what kind of pork deal he needs for WV to vote for HR1.
