Ohio Gov. Mike DeWine has signed a state budget that includes a provision allowing medical providers to deny services to LGBTQ people based on moral, ethical, or religious objections.
In his own words, the $74 billion state budget, which was signed late on Wednesday, speaks to what pulls us together and it reminds us that we have so much more in common than the things that pull us apart, he said, according to News 5 Cleveland.
Besides focusing on infrastructure, tax cuts, school funding, and access to broadband, the budget also includes anti-LGBTQ medical refusal language.
According to the Human Rights Campaign, the provision allows medical practitioners to deny medical care based upon the providers personal beliefs, including for LGBTQ people in Ohio.

(6,017 posts)If it reaches them, my prediction is they want to split the difference between personal opinions of others based on religious beliefs and LGBTQ equality as if they are intrinsically equally. Sorta like how Fox News does it.
The end result I fear will be a "balance" that is heavily skewed at the enforcement end toward "religious liberty" because any government entity will be only allowed to use the least restrictive means in restricting people imposing their religious beliefs on others. Which lately all too often means religious liberty wins.

That nice, little man is a strong supporter of Trump and is just like him. The party in Ohio is the most corrupt in my lifetime and we have seen some doozys.

Its against the entire Hippocratic Oath to deny care. The bill can't possibly say that.

(3,761 posts)But it does explicitly authorize a medical practitioner to deny any health care service if they claim it violates their conscience. It also protects practitioners from being sued for withholding care, but does allow them to sue if they are forced to provide it.
The key paragraph is in the so-called Medical Practitioner Conscience Clause, which starts on page 319 here:
Recognizes the authority of a medical practitioner, health care institution, or health care payer to decline to perform, participate in, or pay for any health care service that violates the practitioner's, institution's, or payer's conscience as informed by the moral, ethical, or religious beliefs or principles held by the practitioner, institution, or payer.

(8,312 posts).... the same ability to have a "conscience" as an individual medical practitioner (who have almost always had some kind of conscience exemption for participation in medical procedures that go against their conscience)...
Then it could very easily, for example, lead to insurers denying single men or men married to other men coverage for PrEP regimens -- even if their doctor thinks it is the best thing for their health. Some might say the only situation their conscience could allow PrEP to be covered would be for married heterosexual sero-discordant couples of reproductive age, so they can continue to have sex without condoms and "replenish the earth".
While I think a doctor who won't give a life-saving medication to someone because they think the patient should live according to the doc's own morals and if they did they wouldn't need said life-saving medication should really hang up their stethoscope, we've recognized the right of Catholic surgeons/hospitals to refuse to do sterilization procedures.
I truly do not think a self-insured company (as the "payer" under this law) should get to dictate whether or not it will cover procedures/meds that don't violate a provider or hospital's conscience -- and in fact are recommended by that doctor in the course of a doctor-patient relationship as medically necessary.

(2,577 posts)It does not come out and say that physicians, hospitals, and insurance companies can deny LGBTQ patients services based on their religious beliefs. It just says these entities can deny care when they feel providing care would be against their religious beliefs. HOWEVER, chances are really, really good that LGBTQ patients will be patients most likely to be denied services. The sad thing is that DeWine excused this by saying the bill just "codifies what is already happening in the state."
I think the world needs to know that in OHIO it is still perfectly legal to deny employment and housing to LGBTQ people. So this just fits in with what else is going on.
I keep thinking about the actual teachings of the gospels these so-called Christians pretend to believe in. As John Fugelsang points out, "Jesus never asked a fellow Nazarene for a copay." Jesus healed whoever sought healing ... and that included lepers. Hmmmm.

I'm not a doctor or a lawyer, but as I understand it, if someone presents to the ER with a life-threatening condition, the hospital is required to provide treatment regardless of considerations like the patient's race, sexual orientation, or even ability to pay.
The aim of this legislation, in my opinion, is to allow, for instance, a surgeon to decline to perform gender reassignment surgery, or a psychiatrist to decline to treat a person with gender dysphoria.

I worry about how far laws like this will be able to go. I am sitting in Indy, helping my daughter and her fiance set up their first home, including a future nursery. Will pediatricians be able to turn them away? Or the fertilization clinic?
In some ways we have come far, but I feel as though we are backsliding with all this new legislation.

What if they refuse treatment to someone who they think is gay but isnt, and that patient dies? What then. Will hospitals, ems, etc have signs that say no lgbt? And what does an anti lgbt law have to do with state budget? Im surprised theres no whites only water fountains in the budget? Never will I step foot in Ohio again.

That way, ALL of us can decide not to use their services. I cannot even imagine the kind of doctor who would do this. Doesn't the AMA have any say on this kind of nonsense? Disgusting.
