Texas grand jury announces murder indictment for Austin BLM protest shooting in 2020

A Texas district attorney announced that a grand jury has indicted Daniel Perry on charges including murder in the death of a man at a Black Lives Matter protest in 2020.
Perry also was indicted on one count of aggravated assault and one misdemeanor count of deadly conduct stemming from the July 25, 2020, rally in Austin, Travis County District Attorney José Garza said.
The indictments say Perry was charged with murder for fatally shooting Garrett Foster, and was charged with aggravated assault because he threatened a woman with imminent bodily injury by driving a motor vehicle in the direction of the woman.
The deadly conduct indictment says Perry put pedestrians in danger by texting while driving, turning at a red light without first coming to a complete stop, turning into an intersection where pedestrians were visible in the crosswalk and "by driving into a group of people in the roadway."

(2,451 posts)Texas is a diverse state. Just because the state house is filled with right wingers, doesn't mean the state is so full of them. Remember Beto came closer than anyone before him in recent memory. Also remember Texas is gerrymandered to the extreme. There are still those of us who believe in justice and democracy.

(26,663 posts)I lived there for 6 years and have many MAGAt relatives there and a few sane ones and many friends, and what I have to say is FUCK TEXAS!!!! When the state elects a decent human being as governor I'll rethink my position.

The jury will have to decide if his story-- that the victim pointed an AR-15 at him with apparent hostile and lethal intent, necessitating him to fire his pistol in self defense -- seems more logical and plausible than that of the prosecution -- which apparently is that he drove into the crowd with malice aforethought. Without video evidence, I think the prosecution will have a hard time proving its case.

I saw dash cam of the car on twitter. Another vehicle at the intersection had a dash cam. Perry didn't stop at the light and drove directly into the crowd. So, assault at the very least.....
If they have close up of the shooting, then that is better.....Just don't know if they have it, but lots of people are always filming everything with their phones....
But then again, the jury might get confused with all of the charges....

And if that assault preceded his killing of the protester, that may be enough -- hell, it would be enough to convince me -- that he wanted to kill somebody.
But its going to be touch and go to put this guy in prison, in any case.
