Court grants permission for judicial review into Unexplained Wealth Order against Donald Trump
Legal efforts to force Scottish ministers to scrutinise the financing of Donald Trumps golf and hotel resorts have overcome a significant hurdle, after the Court of Session granted permission for campaigners to seek a judicial review of the Scottish Governments position.

Avaaz, a US-based non-profit activism organisation, petitioned Scotlands highest court after MSPs rejected calls to pursue an Unexplained Wealth Order (UWO) against the former US presidents Scottish firms.
The government has said that any decision to apply for a UWO is a matter for ministers, with the Civil Recovery Unit (CRU) handling any applications to the courts in practice.

(10,095 posts)I think it was Joyce Vance who said on Nicole Wallaces show that even if the DOJ decides to investigate Trumps role in the planning and execution of 1/6, it would take at least two years. Thats ridiculous. By then Trump will be riding down his golden escalator to another GOP nomination, at which point any indictment would truly be seen as political. I dont know whether we need more investigators or just investigators who arent afraid of the optics of investigating a former president.

(5,788 posts)... The article states that the government has refused to investigate, and that a non-profit organization is suing to force them to do so. Doesn't sound like an expedient process to me.
My presumption is that if the government doesn't want to investigate, it ain't going to happen.

(5,788 posts)... it seems like Scotland's government does not want to investigate, and an outside, American, not-for-profit is trying to force them to. I would think that, in the end, it will be up to the government to decide, and it seems like they have already decided. Good luck with that.

(10,074 posts)Winnipeg Canada. I have been a member for many years but they are well known in political circles because of their millions of members. They have a seat at many tables and are taken seriously. They have saved lives in different countries, I remember saving women from being stoned to death because of the backlash. I would not count them out in convincing people the right thing to do.

In a ruling issued on Wednesday by the court of session, Scotlands civil court, Lord Sandison said he believed the Avaaz case had real prospects of success [and that] there was a sensible legal argument to be had on the matters raised by the petition.
...
Sandison allowed the Avaaz application to proceed even though it was technically time-barred, and also decided a future judicial review could investigate Trumps finances, not just the dry technical question of whether ministers can order a UWO inquiry.
...
The question comes to be whether the petition raises matters of such live and substantive public importance as to render it in the interests of justice to allow it to proceed out of time, Sandison said.
