Texas Abortion Law Back In Effect As Appeals Court Blocks Injunction.
Source: forbes
Texas near-total ban on abortion has been at least temporarily reinstated after a conservative appeals court ruled in favor of the state Friday, blocking a lower court ruling that barred the state from enforcing the law while litigation over its legality plays out.

(26,727 posts)It's just temporary until the DOJ can respond to the motion for a stay. That's expected Tuesday. If anything, it was odd that Pittman didn't temporarily stay his ruling for the few days that it would take for an emergency appeal.
Now... we are talking about the 5th circuit, so it wouldn't be a surprise for the eventual ruling to go the same way.

Let the Texas men fuck themselves and you will see the laws change!
Women are armed and rape is illegal.

(26,727 posts)If a progressive pro-choice woman is in a relationship with a progressive pro-choice man... what good does it do to "say no to sex"? And if it's a conservative woman with either a liberal man or a conservative man... why would she listen to this call?
It only makes sense if we imagine a liberal woman who is sleeping with an anti-choice man...
... and what sense did that make in the first place?

(1,654 posts)They certainly don't want you to have a choice in the matter, no matter what your religion or personal beliefs teach. Can they even think how much longer it takes to even find out you're unexpectedly pregnant. First if you work 2 jobs or are working and caring for other children and your house, you might not even be aware you're late. Then you think you're late because of the stress and how rushed you are. You often don't have home pregnancy detection kits at home because they cost money and you didn't think you needed to spend it.
When I was unexpectedly pregnant we were deep in debt and didn't know how we would manage. I had my child but I had wanted a second child, just not at that time, but I would not begrudge anyone for making their own choice for whatever reason. I remember the panic I felt. The fact that many societies and religions believe life begins at first breath, not conception, does not phase the authoritarians to whom no other opinion matters but their own, and especially the cynical, amoral politicians who really don't care one way or the other - they just want to fulfill the demands of their constituents so they will continue to vote for them.

Abortion care is a calling for this Texas doctor. Now he faces a dilemma: Risk lawsuits, or quit.
Joe Nelson is weighing his options as courts weigh in on the nations strictest abortion ban

This story has been updated.
AUSTIN Joe Nelson arrived at the abortion clinic at 8:30 a.m. on Sept. 8. The doctor made himself a cup of coffee, chatted with the receptionist, then settled into a desk cluttered with paperwork and maxi pads. He answered some emails. Then he opened his book on Zen Buddhism and read.
He did not see a patient for almost two hours.
Before Sept. 1, when Texas banned almost all abortions, Nelson rarely sat down. The only full-time doctor at Whole Womans Health in Austin, he hustled from room to room. For lunch, he would scarf down a protein bar.
Nelson used to perform up to 30 abortions a day; since the ban took effect, he might do two or three. That didnt change when a federal judge issued an injunction on Oct. 6, temporarily blocking the law, which bans abortions once early cardiac activity can be detected, around six weeks gestation, before most people know theyre pregnant. Like many other doctors in Texas, Nelson decided to continue complying with the ban until other courts weighed in. On Oct. 8, the conservative-leaning U.S. 5th Circuit Court of Appeals lifted the injunction. Abortion after six weeks is, once again, illegal.
[ Despite latest court ruling blocking Texas abortion law, most providers are still reluctant to defy ban]

(9,971 posts)Justices have been saying for years that they are understaffed. Plus, population shifts to southern states have meant that those districts are handling more cases while others may be handling fewer. With reorganization and expansion of justices, Biden can add progressive justices that will help balance the right-wing Neanderthals on the 5th circuit. Its been well over 180 days for the group studying the courts. When will we hear from them? I know Im impatient for things to get done, but we have only until January 2023, after which nothing will get done if Republicans retake the House and they are already gerrymandering like crazy to ensure that happens.

(12,582 posts)When I practiced law in South Carolina and one of my clients got sued, I always filed a counterclaim against the plaintiff. In South Carolina pleadings, counterclaims don't even have to be related to the initial action, so suddenly the plaintiff and his attorney -- who thought they were looking at easy pickings -- had something at risk. It changed the entire dynamics of the relationship, as far as settling the case went.
So go ahead, people and their lawyers who are counting on a quick payday. Let's see how you feel when you realize you might lose everything. Throw me into that briar patch.
