Andrew Cuomo Is Charged in Sexual Misconduct Complaint

The misdemeanor complaint was based on the account of one of the dozen or so women whose accusations of sexual harassment against Mr. Cuomo formed the basis of a state attorney generals report that eventually led to his resignation in August.
For Mr. Cuomo, the complaint was a serious and potentially devastating development, as he continues to fight the allegations and attempts to discredit the report. It also served as a stunning chapter in the political demise of a man who dominated state politics for a decade, seemed on a glide path to a fourth term and, less than a year ago, was hailed as a national hero of the coronavirus pandemic.
Now Mr. Cuomo, who has spent time living on Long Island since his resignation, will be required to appear in court in Albany on Nov. 17 to be arraigned on a charge of forcible touching.

It would have been even better if they had included what he intended to do with his memory of the event, something like 'so he could masturbate later while remembering the grope.' Maybe they could have added a lewd conduct charge.

Forcible touching
§ 130.52 Forcible touching.
A person is guilty of forcible touching when such person
intentionally, and for no legitimate purpose:
1. forcibly touches the sexual or other intimate parts of another
person for the purpose of degrading or abusing such person, or for the
purpose of gratifying the actor's sexual desire; or
2. subjects another person to sexual contact for the purpose of
gratifying the actor's sexual desire and with intent to degrade or abuse
such other person while such other person is a passenger on a bus,
train, or subway car operated by any transit agency, authority or
company, public or private, whose operation is authorized by New York
state or any of its political subdivisions.
For the purposes of this section, forcible touching includes
squeezing, grabbing or pinching.
Forcible touching is a class A misdemeanor.

(16,858 posts)I guess I hadn't really thought about what the statute actually said. I suppose he'll claim that he touched the woman accidentally, with no sexual gratification intended. Or he might deny touching her at all. There will probably be other witnesses who testify about Cuomo's character, or lack thereof. It will be interesting to see what is said about his intentions.

(1,666 posts)Even if you videotaped yourself with a signed, notarized document saying you bought all those illegal drugs for personal use, and that is true, they would still say you intended to sell them and charge you for it. They dont care what your real intent was, they tell you what it was and charge you accordingly.

(16,858 posts)I've known people who got charged with intent to sell. Sometimes it sticks and sometimes it doesn't. Whether a charge of intent to sell sticks or not seems to depend a lot on who you get for a lawyer.
