Los Angeles County sheriff won't enforce vaccine mandate

Source: ABC News

Los Angeles County Sheriff Alex Villanueva said Tuesday he won’t comply with a mandate requiring deputies be vaccinated against the coronavirus or face termination, claiming thousands could leave the department and that will lead to more crime.

His defiance to the order that was approved last summer by the LA County Board of Supervisors brought a rebuke from Janice Hahn, one of the panel’s five members who unanimously backed the policy.

“He is putting both his deputies and the public they come face-to-face with every day at unnecessary risk,” she said in a statement. “What we need from the sheriff right now is leadership, for once.”

Villanueva, who faces a reelection challenge next year, has defied other health orders during the pandemic. Last month, he said he wouldn’t have his deputies enforce a mandate requiring vaccinated and unvaccinated people wear masks at indoor public settings.

because 10 the sheriff is an elected position and 2) this has been explored in the past and most recently, according to this article there are 4 ways to remove a sheriff:

1. Amend the county charter. “The California Constitution allows a county charter to provide for the removal of an elected sheriff, as well as other elected officers. And the attorney general has given an opinion that a county charter may grant a board of supervisors the authority to remove a sheriff for cause by a four-fifths vote,” Castro-Silva said.

2. Recall the sheriff. “The California Elections Code establishes the specific procedures for placing on the ballot the recall of an elected official, including the sheriff,” he said.

3. A civil grand jury lodges an accusation of willful or corrupt misconduct that leads to a jury trial and conviction.

4. The state attorney general — or a private party with the AG’s permission — files an action challenging the sheriff’s right to continue to hold office, which would lead to a trial.

None of these will have a quick resolution.

The LA County recall procedure requires

Up to 160 days to collect the requisite number of signatures (pp 7-8)
+30 days from filing the petition to validate the signatures (p. 12)
+14 days while the the governing body considers the certificate of sufficiency received from the county elections official (p. 14)
+88 to 125 for the election to be held (p. 14)

So the minimum amount of time is 133 days but more realistically this would be in the 150 to 180 day range.

(please note that this is a cursory reading of the source document and did not include reviewing the actual legal code).

We don’t want them enforcing immigration law, but we want them to enforce the laws we do agree with! We need to come up with an easily understood guide for sheriffs around the country to follow on what laws we will let them slide on ignoring and what ones they need to enforce.

We can make it easy on them. If the law is something we agree with, they need to enforce it. If the law is something we don’t like, they can ignore it. Or more accurately, if Democrats like the law, enforce it. If we don’t, don’t enforce it. Also, the fine print needs to make sure the Red State sheriffs understand they can’t do the same with things like gun control because we say so.

Hash it out in court. I’ve about had it with morons who hide behind their badge to break the law and encourage others he leads to do the same.

These people are a special class of idiot scofflaws and should be dealt with harshly. The sheriff believes it’s an inconsequential law, and he can choose to ignore laws us doesn’t like politically.

Selective enforcement based on the whims of local sheriffs has always ended badly, don’t they watch the movies in Los Angeles?
