Ohio governor signs 'born-alive' abortion measure into law
Source: The Hill
Ohio Gov. Mike DeWine (R) signed a bill into law Wednesday that requires doctors to try to save the life of a baby who is born alive after an attempted abortion or face criminal charges.
Senate Bill 157, called the "Born-Alive Infant Protection Act" by supporters, also mandates that doctors report all instances in which a baby is born alive after an attempted abortion. And it prohibits clinics that perform abortions from working with doctors who teach at medical schools affiliated with state universities or other public institutions.
The bill would require doctors to complete a "child survival form" or face a third-degree felony.
-snip-
Opponents of the bill argue that it restricts access to abortion by threatening and intimidating physicians.

(28,471 posts)How can I prove it? Easy, simply look at how many Republican politicians claim to oppose abortion because its a "life" yet the vast majority of them then refuse to help with things like affordable healthcare for children or child care.
In the end really most Republican politicians do not give a damn about children and abortion to them is simply another tool they use rally a significant number of their voting base around.

(22,212 posts)That part is just red meat for the moronic, gawd bothering base. Nothing more.
The kicker is the prohibition on docs associated with Ohio funded medical schools from working with clinics that provide abortion services.....like Planned Parenthood. That part is complete bullshit that won't...hopefully....hold up in court.

(60,968 posts)Aside from the fact that any doctor would as a matter of conscience and medical ethics Save a viable baby. It was a right wing smear that Democratic politicians were in favor of killing a live baby born when an abortion was done.

(60,968 posts)I hope that I am misinterpreting your words. From what I thought you wrote - Are you saying that it would be up to woman whether a child who was born alive when she wanted an abortion would get whatever care it needs? Would that include even the routine care given any baby who is born or are you saying the woman could reject extraordinary care for the baby?
The fact is that under the current laws and medical practice it would be very very unlikely that a baby would be viable. There are only very very limited cases where you can get an abortion at a point where viability is likely. Two reasons are if the child has problems noot consistent with life or the mother's life or health is at risk. In the latter, the family might have made the (obvious correct) decision to save the mother.
In coverage on the terrible Mississippi law, one source linked to a CDC report that showed that over 92% of abortions happened before 13 weeks. Very few women will carry a baby for 7 to 8 months and then - assuming no problems with her health or the baby's - decide at that point to have an abortion.

(15,399 posts)Some late term abortions are for fetal abnormalities severe enough that if born, the baby may only survive a few hours or days in agony without heroic intervention.
See "Baby Sun" in Texas.
Never mind, I guess. The State will pull the plug on the baby within days of it being born live, anyway. And stick the parents with a near million dollar NICU bill.
Instead of a $500 or so bill for a therapeutic abortion, that would be a mercy for both mother and baby.
On edit - I realize I'm only discussing a live birth situation. Other than forced early labor using drugs, how would an abortion end up with a live birth?

(60,968 posts)What I objected to was that someone essentially took the right wing bait (which is in that bill) and said it was still the woman's decision.

(21,900 posts)1) Leave it up to the states
2) Water it down, give states the option of banning it after 14 weeks and parental notification for minors
3) Keep the status quo (states can ban it after 24-26 weeks)
4) Increase it to 30 weeks
5) No restrictions at all, no state can impose any restrictions on abortion at all
I'd do it myself, but I can't make polls.

Any attempt to use the recipients health insurance to reimburse the hospital shall be punished as insurance fraud.

(602 posts)Besides the "born alive" provision, which I suppose will get little opposition, there are provisions that abortion clinics cannot be staffed by any doctor who teaches or practices in a state-run hospital or medical school. I don't know the availability of qualified abortion doctors in Ohio but I suspect this forces abortion clinics to choose from a smaller - and less desirable - range of doctors.

Okay, so I may come across as rather moderate here, but I have no objection to treating infants born alive during abortion the same way one would treat any infant born at that age/weight -- and the weight part is only a guesstimate w/ ultrasound, they won't know the real weight until they are out.
And they say anyone who opposes something that seems so simple on the face of it is obviously a horrible person who hates babies.
But they forget/don't know that what I said above is already federal law, and add on fine print that unconstitutionally limits doctors in their practice of medicine, says that ectopic pregnancy must be reiimplanted, etc, then throw the bill on the wall to see if it sticks.
I wish I had a better word than what came to mind (fuckers), because fucking isn't wrong itself. Fucking people who can get pregnant over by writing deceptive laws IS wrong.
(Edit: apparently when I answered my phone I hit submit before I was done typing. Sorry.)

Unless the doctor can prove the fetus has no soul within it, aborting the fetus shall be a felony of the 1st degree.
