Rudy Giuliani and One America News sued by Georgia poll workers falsely accused of electoral fraud

Two election workers who counted votes for the 2020 presidential election filed a defamation lawsuit Thursday against the parent company of One America News, senior staff at the far-right TV network and Rudolph W. Giuliani, who served as a personal lawyer to former president Donald Trump.
Ruby Freeman and her daughter Wandrea Shaye Moss, who worked in Fulton County, Ga., allege that One America News and Giuliani, who frequently appears on the network, knowingly spread misinformation about them, including falsehoods that they logged illegal ballots for Joe Biden in the election.
The two women have become objects of vitriol, threats, and harassment
because of a campaign of malicious lies, their attorneys wrote in the suit, filed in the U.S. District Court for the District of Columbia. Deliberate efforts to spread disinformation about Americas election workers undermine the integrity of American elections
and accordingly, threaten democracy.
The legal action seeks to force the defendants to delete false statements about the two women from their platforms. It also asks for compensatory and punitive damages.

The Big Lie lawsuits all rested on well, lies. The courts mocked them.
Time to pay up for attempting to purposely destroy democracy with malice afore sight and armed only with a Big Lie.

the law firm could hire plenty of IT pros that could use AI to transcribe and analyze/search huge amts of rw radio recordings and podcasts and youtubes.
at the very least the Ga rw radio station local blowhards would have piled on, including the 14 that Georgia 7, Georgia Tech 5, Georgia Southern 2 broadcast sports on/support

(6,600 posts)The tricky part always seems to be proving "the person knowingly or recklessly made a false statement."
It's the "knowingly or recklessly" part that's difficult. If someone says something they honestly believe to be true, that condition is not met.
Also, if Rudy made false accusations & supplied a misleading video & then OAN reported on it saying "Rudy Giuliani said this..." & "Rudy Giuliani provided this video..." then OAN did not make false statements, those statements are true because Rudy did in fact say those things & supplied the video. Now, if someone at the network went beyond reporting & began editorializing, making their own statements instead of just reporting on the statements of others, a case could be made against that person, but a case against the entire company is much more difficult.
For example, consider the Dominion case against Fox. A week ago the judge denied Fox's motion to dismiss, & noted "Whether Dominion ultimately will prove Foxs actual malice by clear and convincing evidence is irrelevant on a motion to dismiss."
There we see the difficulty the plaintiffs face, proving "actual malice by clear and convincing evidence." Proving actual malice by an entire company is not easy.
