Pamela Moses granted new trial after being sentenced for illegally registering to vote

A motion has been granted for a new trial for Pamela Moses, the Memphis woman sentenced to six years in prison earlier this month after being convicted a year ago on charges of illegally registering to vote.
Moses, 44, was convicted in November 2021 of illegally registering to vote in 2019 and was sentenced to six years and one day. She maintains that she was unaware that she was ineligible to vote.
Criminal Court Judge W. Mark Ward granted the motion for the new trial Friday.
The case drew national attention at the beginning of February when The Guardian, a British news website, published a story on the case.

Moses was convicted last year for submitting a document in 2019 indicating she was eligible to vote. Prosecutors said she knew that this was false, because just months before a judge issued an order telling Moses she was still on probation for a 2015 felony. In Tennessee, people on felony probation cannot vote.
When she turned in the form, Moses believed that the probation for her 2015 felony had expired, and a probation officer even signed a certificate indicating that this was the case and that she was eligible. Prosecutors said that Moses deceived the officer into signing the certificate.
But evidence obtained by the Guardian this week showed that corrections officials investigated the error immediately afterwards and determined that the probation officer identified as Manager Billington was negligent and made an error while Moses waited in the lobby of his office..............................

(1,121 posts)she would have waited and stormed the capital on January 6, 2021! Instead, of facing 6 years in prison for allegedly "illegally registering to vote", at worst she'd be charged with a minor misdemeanor, probation, and a de minimus fine. Got to love our justice system!

(CNN) A Pennsylvania man has been sentenced to five years of probation after pleading guilty to casting a vote in the name of his deceased mother in an effort to reelect then-President Donald Trump, according to court records and Delaware County District Attorney Jack Stollsteimer's office.
Bruce Bartman, 70, received the sentence Friday after entering a guilty plea to two counts of perjury and one count of unlawful voting. Bartman will also lose his right to vote for four years, pursuant to Pennsylvania statute, the district attorney's office said in a news release.
Voter records show that Bartman used Pennsylvania's online voter-registration portal to register both his late mother, Elizabeth Bartman, and his deceased mother-in-law, Elizabeth Weihman, who died in 2019 -- illegally registering both as Republican voters, the district attorney's office said. Bartman then requested, filled out and sent in the absentee ballot for his deceased mother for the 2020 general election.
Bartman's attorney, Samuel Stretton, told CNN that his client regrets the decision. Stretton said Bartman had explained to the court that because of the coronavirus pandemic, he had been isolated at home and was misled by "propaganda and statements" that were made about voter fraud. "This was his way of misguided political dissent," Stretton said. "He accepts the responsibility."

Bruce Bartman, 70, pleaded guilty to using information from his deceased relatives in an attempt cast illegal votes for Donald Trump in the 2020 presidential election. One of those illegal votes was counted, according to Delaware County prosecutors. A Marple Township man who illegally registered his dead mother as a Republican and cast a vote on her behalf in the 2020 presidential election has been sentenced to five years of probation, Delaware County prosecutors said.
Bruce Bartman, 70, pleaded guilty to felony counts of perjury and unlawful voting last December after investigators discovered he had successfully cast a mail-in ballot for his mother, who died 12 years ago. He also attempted to obtain a mail-in ballot for his dead mother-in-law, but the request was flagged by state officials.
Bartman used an old driver's license number to request the mail-in ballot for his mother and sneak through Pennsylvania's Statewide Uniform Registry of Electors system. He used the ballot to cast a vote for former President Donald Trump on Oct. 28.
Bartman attempted to use his mother-in-law's social security number to obtain another ballot, but was thwarted when he falsified additional information requested by the state.
