Lawyers for Donald Trump, Ivanka Trump and Donald Trump, Jr., on Monday formally asked to delay their court-ordered testimony before New York Attorney General Letitia James.
The three Trumps had been ordered by a lower court to comply with James' subpoenas and testify before her investigators by March 10; Monday's filing asks the state Supreme Court's Appellate Division to delay that testimony while they file a full appeal.
The filing asks the appellate court to find that the Trumps are the targets of "impermissible selective prosecution" by James, who has used strong language in warning publicly that she is turning the full strength of her office on a probe of the former president's business.

The courts have not been friendly to him thus far. Nor should they be--he's a criminal.

Former President Trump on Monday appealed a New York judge's order that he comply with the state attorney general's subpoena for his testimony as part of a wide-ranging civil investigation into his business practices.
Trump's lawyers filed a notice that they were seeking a review from the state appellate court after Judge Arthur Engoron earlier this month ordered the former president and his two eldest children to sit for a deposition with the attorney general's office.
Engoron's ruling this month rejected Trump's effort to quash the subpoenas and prevent New York Attorney General Letitia James (D) from moving forward with her probe.
"In the final analysis, a State Attorney General commences investigating a business entity, uncovers copious evidence of possible financial fraud, and wants to question, under oath, several of the entities' principals, including its namesake. She has the clear right to do so," Engoron wrote in the decision.

..........The New York appellate court has not yet scheduled briefings for Trump's appeal or ruled on whether to delay Engoron's ruling from taking effect.

(4,616 posts)Where the average citizen is nailed for even the smallest violations, need LOTS of $$ to go though any trial let alone a big one, and if you don't have the big bucks or connections, you're off to jail. But there is the hope of that "jury of your peers" will surely be reasonable. You know, those 12 people who go unchecked and unmonitored that really don't want to be there anyway and think you "look guilty". But the likes of the Trumps, well they use the courts like a personal assistant. But hey, the system looks great on paper!

As the wheel of civilization rolls toward justice, it is appropriate that we should observe with trepidation the temporal passage of every destined spoke. Trump will fall. The planet's precious breath chokes and gasps in a needful agony of demand for it. Appreciation for the beauty within nature's inevitability is an acquired talent of which we have all been denied instructive example for too long. About exhausted my whole vocabulary just to avoid that most painful word, hope.

That being said, it's a paper thin defense that will merit about 22 seconds of deliberation. Full speed ahead. And let's see what happens if he's a no-show.
