District Attorney DROPS Charges Against Texas Woman for 'Illegal Abortion'

A Texas woman who was charged with murder on Friday for a self-induced abortion will have her charges dropped. “Yesterday afternoon, I reached out to counsel for Ms. Lizelle Herrera to advise him that my office will be filing a motion dismissing the indictment against Ms. Herrera,” Gocha Allen Ramirez, the district attorney for Starr, Jim Hogg, and Duval counties, said in a statement Sunday. “In reviewing applicable Texas law, it is clear that Ms. Herrera cannot and should not be prosecuted for the allegation against her.” Herrera was charged by the Starr County Sheriff’s Office on Friday for the “illegal” abortion, a procedure Texas has managed to ban after six weeks. “The issues surrounding this matter are clearly contentious, however based on Texas law and the facts presented, it is not a criminal matter,” Ramirez wrote Sunday.

I read yesterday that the sheriff's office was overreaching because the six week ban is a civil matter, not a criminal one. IOW, Herrera could still be sued by some Christian yahoo with a bug up his ass and a desire for some quick cash.

Sadly, a self induced abortion requiring hospital treatment will not wake up the Christian patriarchs as to what desperate circumstances will drive women to try. They will just fold their soft, pink hands and thunder "thou shalt not: while writing even more restrictive and appalling legislation.

Having a miscarriage is traumatic enough without enduring this cruel legal and political nightmare. I hope the medical facility whose employee(s) violated HIPAA will be sued into oblivion in federal court. Unfortunately, one of Abbott’s gifts to Texans was tort “reform” which limits damages to $250,000. Abbot’s incompetence and corruption knows no bounds. Perhaps when enough corporations are sued out of business, will there be an opportunity to repeal this ugly and abusive law.

Their intention was to make an example of this woman and scare the bejeezus out of TX women. She MUST sue them. And, I say that with a heart full of empathy because I can’t imagine the pain she and her family are in at this moment. I am sure she wants to put this behind her and making these assholes pay would sure help in that regard.

I'm like WTF? What does a Sheriff know about anything medical? Maybe they're OK with stolen vehicles and crap like that..but this is bullsheet.




Oh and this is Henry Cuellar's district........I smell a rat!
DA is not up for re-election. I don't know about the sheriff, but they usually parade themselves around drug busts and crap like that...but Henry Cuellar...yep...runoff...Jessica....next month....

I could see Henry's shadow campaign getting real dirty with this. Oh well, it back fired.

These district attorneys make me proud of the legal profession in Texas. I know one of the DAs and he is a good man. These District Attorneys have pledged not to prosecute any women who has an abortion
