Trump says in sworn affidavit he doesn't have documents sought by New York Attorney General

In a one-page signed affidavit filed with the court Friday, Trump wrote, To the best of my knowledge, (i) I do not have any of the documents requested in the subpoena dated December 1, 2021 in my personal possession; and (ii) if there are any documents responsive to the subpoena I believe they would be in the possession or custody of the Trump Organization. 2. At all relevant times, I have authorized, and continue to authorize, the release of any responsive documents to the Office of the Attorney General.
Trump signed the document on April 27, the day after the judge issued a written order holding him in civil contempt and fining him $10,000 a day. The former president has appealed that order.
Trumps lawyer also submitted a sworn affidavit that she had checked the records, and during a hearing told a judge she had gone to Florida to speak with Trump himself.

(111,351 posts)it might be believable in TFG's case. What is even more believable is that the documents in question are sitting in Mara Lardo or even rental storage elsewhere in Florida, ready to be struck by a little anti prosecutorial lightning if somebody squeals about it.
I've known a few of these guys, sad to say, and I know how they think and how they operate.
TFG undoubtedly thinks his good buddy Gov De Satan will protect him and in the shortest term, he might be right. Long term will be different. By then, his paperwork might be hidden in Moscow, the one with Putin in it.
This is one reason it takes so long to catch these guys.

(15,224 posts)Cant they subpoena the Trump organization? His comments suggest the Trump organization may have the requested documents. It cannot be legal to hide via corporate veil when there is obvious intent to defraud.

"Mr. Trump's personal affidavit is completely devoid of any useful detail. Notably, it fails to state where he kept his files, how his files were stored in the regular course of business, who had access to such files, what, if any, the retention policy was for such files, and, importantly, where he believes such files are currently located," he wrote. The judge also found the sworn statement from Trump's attorney unsatisfactory.

The judge previously said Trump could end the contempt if he complied with the subpoena or him or his attorneys detailed their efforts to search for documents sought by the subpoena. He called Trump's lawyer's earlier response "boilerplate."..................................

(7,403 posts)It seems that if the retention period had not yet expired on the date of subpoena, then he either delivers the documents or face additional charges related to the destruction of the documents. This is a lose-lose situation for Trump.
