Texas State Bar sues AG Paxton for 'dishonest' challenge of 2020 election results

Less than 24 hours after Attorney General Ken Paxton clinched the Republican nomination for his re-election, the Texas State Bar sued him Wednesday over his dishonest attempt to overturn the 2020 presidential election.
The short, four-page lawsuit, filed in district court in Paxtons hometown of Collin County, contains identical claims to those in litigation filed earlier this month against Paxtons top deputy, First Assistant Attorney General Brent Webster. Paxton violated the bars rules of professional conduct by including false and misleading statements, according to the association.
His allegations were not supported by any charge, indictment, judicial finding, and/or credible or admissible evidence, and failed to disclose to the Court that some of his representations and allegations had already been adjudicated and/or dismissed in a court of law, the suit reads, referring to a number of voter fraud claims that had already been debunked at the time Paxton filed his petition.
The four battleground states that Texas sued Georgia, Pennsylvania, Michigan and Wisconsin were then forced to spend time, money and other resources responding to these claims, the suit said.

(145,666 posts)It is the Texas State Bar that is suing Paxton who is still currently a member of the State Bar. Why do you think that the State Bar of Texas does not have standing over a member of the State Bar?

(6,476 posts)As Attorney General he was arguably acting in an official capacity-I thought those suits had to be filed in Travis County. I'd rather he be judged by a Travis County Judge or Jury.
Isn't that a mandatory venue statute?

(145,666 posts)As a general rule, you need to sue a defendant where one of the parties live. I will try to find the pleadings and see what was alleged as to venue
