Trump loses appeal, must testify in New York civil probe

NEW YORK (AP) Former President Donald Trump must answer questions under oath in New York states civil investigation into his business practices, a state appeals court ruled Thursday.
A four-judge panel in the appellate division of the states trial court upheld Manhattan Judge Arthur Engorons Feb. 17 ruling enforcing subpoenas for Trump and his two eldest children to give deposition testimony in Attorney General Letitia James probe.
Trump had appealed, seeking to overturn the ruling. His lawyers argued that ordering the Trumps to testify violated their constitutional rights because their answers could be used in a parallel criminal investigation.
The existence of a criminal investigation does not preclude civil discovery of related facts, at which a party may exercise the privilege against self-incrimination, the four-judge panel wrote, citing the Fifth Amendment right against self-incrimination.

(5,586 posts)So he'll have a lawyer sitting next to him telling him what to answer and what not to answer. He's been deposed hundreds of times, and NY won't be given leave to just ask anything they want about any subject they want. Trump will still have 5th amendment protections and won't be required to incriminate himself.

If he's ever going to die, that is, Heaven doesn't want him and hell thinks he'll take over.
Tack on another 6-8 months till the State Supremes uphold this decision.
Depositions MIGHT take place in 2023. Maybe.

Our investigation will continue undeterred because no one is above the law, New York AG Letitia James tweeted immediately after the decision.
Attorneys representing the Trumps did not immediately respond to calls from The Daily Beast.
The AGs office has spent more than three years investigating allegations that the Trump Organization has routinely inflated property values at golf courses and skyscrapers across the country to acquire bank loans on more favorable terms or reduce tax bills. Investigators recently roped in the major real estate firm Cushman & Wakefield, demanding documents showing how it allegedly helped the Trumps lie on official documents. While aspects of this case appear criminal, the AG is pursuing a civil case that could result in New York state seeking to dissolve the former presidents company.
