U.S. asks court to reverse order lifting airplane mask mandate

WASHINGTON, May 31 (Reuters) - The U.S. Justice Department on Tuesday asked a federal appeals court to overturn a U.S. District Court judge's April order that declared the government mandate requiring masks on airplanes, buses and in transit hubs unlawful. Hours after the federal judge in Florida declared the mandate unlawful, the Biden administration said it would no longer enforce it.

The Justice Department told the appeals court that the Centers for Disease Control and Prevention (CDC) order issued in January 2021 was "within" the agency's legal authority. The CDC did not immediately respond to a request for comment Tuesday on whether it would reinstate the requirement if the ruling was overturned.

Days before U.S. District Judge Kathryn Kimball's April 18 order, the CDC had extended mask requirements through May 3. The CDC said earlier this month it still recommends travelers continue to wear masks in airplanes, trains and buses.

The Justice Department's appeal came just hours before a appeals court filing deadline.

After this recovery I intend to only wear the KN95, it's smothering, especially on a long flight, but better than how I feel today. Still testing positive with all symptoms. It is not horrible. But this should not be happening at all.

Not that it hasn’t been miserable; it has. I caught it I’m certain from an unmasked fellow sitting across the aisle from me coughing for the entire 2 and a half hour flight I was on last week. I was masked of course, but the few times I lowered it to take a drink of water was all it took. This guy knew he was sick, you can’t cough like that and not know.

So my question to you sir, is just how does the Biden Administration present a “compelling argument” to an American public that is full of inconsiderate louts like this guy? Do they even talk about such things in the circles you move in?

30. for me, today is day 4 of positive Covid, caught on plane/airport, who knows.

I will survive too, but even vaxed and boosted, for me, its like a really bad congestive cold. Day 4 I am sheltered in, dry coughing, feverish, fatigued.
You have to eat/drink sometime on a long flight travel day & there are plenty of unmasked covid suspects lurking on planes/airports. The rule of thumb is the question: have you spent 15 minutes within 6 feet of someone while unmasked within 48 hours of the onset of symptoms? I think that is misleading since the concentration of the sardine cans of airport/planes needs to be further evaluated. Before this surge of the crowds packing into the air travel industry the air vent tests were performed on empty planes and airports.
But it will be a cold day in hell for this crowd to want to re-evaluate the environmental safety of the industry.

29. negative covid test is in place for most US citizens returning,

from many countries. its a form you have to sign required by the US State Dept and verified by the ticket agent of the returning carrier. The checks are random for the test at U.S. border entry.

many countries have lifted the negative covid test, but want to see proof of vaccine.
It gets complicated if a person has not been vaccinated.

I had to take a monitored test and submit the results- and proof of vaccination - before I could travel last month Wore a mask the whole time I was in the airport and on the plane- and tested positive 2 days after I got home
