Bannon Subpoenas Pelosi And Jan. 6 Panel In Attempt To Hit Back At Contempt Charges

Former Trump White House chief strategist Steve Bannon has reportedly subpoenaed House Speaker Nancy Pelosi (D-CA) and members of the committee in an attempt to push back at the contempt charges he faces, according to CNN. Bannon is scheduled to go on trial next month in the contempt charges the Justice Department brought against him last year for failing to cooperate with the Jan. 6 Select Committees investigation.
Late last year, Bannon was charged with two counts of contempt of Congress follow his refusal to comply with the committees subpoena. Bannon pleaded not guilty.
In an effort to fight the contempt charges hes facing, Bannons legal team reportedly subpoenaed 15 lawmakers and congressional staffers to testify at his trial next month, one of Bannons attorneys and copies of the subpoenas obtained by CNN indicated. The subpoenas reportedly target all nine members of the committee, three committee staffers and House general counsel Douglas Letter. Additionally, Bannon reportedly subpoenaed Pelosi and other House Democratic leaders such as Majority Leader Steny Hoyer (D-MD) and Whip Rep. Jim Clyburn (D-SC).
CNN noted there are challenges to compel members of Congress to testify, citing protection of their legislative activity under the Constitutions Speech and Debate Clause. Therefore, lawmakers and staffers subpoenaed by Bannons legal team could possibly file a motion to reject those subpoenas.

Justice delayed is justice denied, and that is just fine with "conservatives".

(36,023 posts)The current defense Costello uses is based on something called 'entrapment by estoppel,' which as a non-lawyer, I take to mean that he doesn't have to produce documents because his team -- M. Evan Corcoran, Robert J. Costello and David I. Schoen -- have filed Bannon's intent "to assert defenses of public authority in this case, including actual and apparent authority." It's too weird to figure out, but seems to have some influence on whether the DOJ can proceed to criminalize the contempt charge from Congress. But what do I know. Any lawyers in the house?

at least it's confusing with regards to Bannon....
I'm not sure how refusing a subpoena leads to entrapment of any flavor though....

(36,023 posts)But all I can think is that he's insisting on some due process rights he thinks he can't get by standing before the Jan 6 committee. So he thinks he can get that in court, maybe, by asking getting them to testify under oath, maybe?
