Judge sends another trove of Eastman emails to Jan. 6 committee

A federal judge Tuesday ordered John Eastman the attorney who developed former President Donald Trumps last-ditch strategy to overturn the election to disclose a batch of 159 sensitive documents to the Jan. 6 select committee, including another email that the judge said presented evidence of a likely crime.
In a 26-page ruling, U.S. District Court Judge David Carter also ordered Eastman to provide 10 documents about meetings Eastman held with a secretive pro-Trump group that included a high-profile leader discussing strategies for overturning the 2020 election.
The 10 documents in question related to three December meetings held by the group. Five documents include the agenda for a meeting on December 9, 2020, the California-based judge indicated. The agenda included a section entitled GROUND GAME following Nov 4 Election Results, during which a sitting Member of Congress discussed a [p]lan to challenge the electors in the House of Representatives. Other meetings of the group took place on Dec. 8 and Dec. 16, Carter noted.
The Select Committee has a substantial interest in these three meetings because the presentations furthered a critical objective of the January 6 plan: to have contested states certify alternate slates of electors for President Trump, he ruled. Dr. Eastmans actions in these few weeks indicate that his and President Trumps pressure campaign to stop the electoral count did not end with Vice President Pence it targeted every tier of federal and state elected officials. Convincing state legislatures to certify competing electors was essential to stop the count and ensure President Trumps reelection.

WASHINGTON States that haven't yet certified their votes for president or that face legal challenges are rushing to resolve any remaining disputes by Tuesday, known as safe harbor day. Under federal law, Congress must count the electoral votes from states that act by Dec. 8 to choose their presidential electors the people who meet next week in each state to cast the actual votes for president and to resolve any remaining legal disputes over their choices. The Electoral Count Act was passed in 1887, after four states sent in votes from two different sets of electors from the 1876 presidential race between Rutherford B. Hayes and Samuel Tilden.
Congress had established no mechanism to resolve fights over competing slates of electors, and it adopted the act in hope of heading off future disputes. Under the law, Congress must count the electoral votes from states that chose their electors and resolve any legal disputes over the choices by the act's deadline, which is six days before the electors meet to vote. Of course, if a state fails to meet the safe harbor deadline but chooses its electors by Dec. 14, Congress can still count the votes.
President-elect Joe Biden has 306 electoral votes to President Donald Trump's 232, with 270 needed to win the White House. The safe harbor deadline, however, is something of a guarantee. If, for example, a state legislature decided to send in its own slate, the law says the electors chosen by popular vote and certified by the governor must be counted by Congress from states that met the safe harbor deadline.

The federal law says a state qualifies for the safe harbor protection if it has resolved "any controversy or contest concerning the appointment of all or any of the electors." State court cases remain active in six states that certified Biden as the winner Arizona, Georgia, Michigan, Minnesota, Nevada and Wisconsin. So they may not be able to claim the protection unless their cases are resolved by Tuesday.

From the above, aside from MN, note that each of the other highlighted states later became the subject of an "alternate" slate of electors. The one missing in that article's above list at the time, was ours here in PA, and apparently all kinds of "organizing" was going on with respect to how to deal with us.
PA signed off on and submitted their official electors on November 24, 2020 -
But as we know, the "planning" had been underway including a televised super-spreader event held in Gettysburg, PA (one day AFTER the official slate was sent in, on November 25, 2020), lead by the loon who wants to be governor, and why he is still walking free defies logic.

President Donald Trump on Wednesday summoned Republican members of the Pennsylvania legislature to the White House after a GOP hearing in Gettysburg in which Trump phoned in to reassert his false claim that he won Pennsylvania by a lot. But on Thursday, no one wanted to talk about the meeting. The White House did not issue a public statement about the visit, and lawmakers who made the trip to Washington were silent.

On Wednesday, Trump lawyer Rudy Giuliani brought his baseless case to a hearing convened in Gettysburg by the all-Republican state Senate Majority Policy Committee. Giuliani alleged that the election had been stolen and covered up with the assistance of Big Tech, the news media, and the courts. Trump called in to the hearing, speaking through attorney Jenna Ellis cell phone held up to the microphone, and falsely claimed: This election was rigged, and we cant let that happen. This election has to be turned around because we won Pennsylvania by a lot and we won all these swing states by a lot.
Afterward, several Republican lawmakers from Pennsylvania were invited to the White House to meet with Trump. CNN, citing two sources, said the meeting was expected to take place in the West Wing. The legislatures Republican leaders the GOP has a majority in both chambers were notably not among the attendees, according to the leaders and their spokespeople.

The White House did not respond to requests for comment about the meeting or who attended. In 2017, the Trump administration stopped making public the names of White House visitors, citing what a spokesperson called grave national security risks and privacy concerns of the hundreds of thousands of visitors annually. State Sen. Doug Mastriano (R., Franklin), one of the Senates most conservative members, was among the lawmakers who went to the White House, legislative sources said. Mastriano played a key role in organizing the Senate Majority Policy Committee hearing in Gettysburg. He did not return a phone call seeking comment.
Trumps session last week with Republican lawmakers from Michigan was attended by legislative leaders. The presidents allies had been pushing to have the state legislature overturn Bidens victory and award the states 16 electoral votes to Trump. After their meeting with Trump, the GOP leaders rebuffed that notion.

Pennsylvania state lawmaker's key role in Trump's election lie
(CNN) Pennsylvania state Sen. Doug Mastriano went out of his way to help advance former President Donald Trump's election lies: He spearheaded a "hearing" at a hotel in Gettysburg a few weeks after the 2020 election, where Trump and his lawyer Rudy Giuliani made false claims about election fraud. He chartered buses to ferry his supporters to Washington on January 6. And he was briefly in charge of the Pennsylvania state Senate's partisan "audit" of the 2020 election.
Now Mastriano's role behind the scenes helping Trump try to overturn his loss to Joe Biden is under renewed scrutiny after a Democrat-led Senate Judiciary report released last week revealed his correspondence with the Justice Department spreading debunked claims of fraud. Mastriano is one of three under-the-radar figures the report singles out for further investigation for their efforts helping Trump try to subvert the election.
Rep. Scott Perry, a Pennsylvania Republican, introduced Trump to a top DOJ official who was open to election conspiracy theories. Attorney Cleta Mitchell helped Trump try to convince Georgia's secretary of state to "find" enough votes for him to win. And Mastriano pushed his fraud claims to the No. 2 Justice official while Trump was trying to convince then-acting Attorney General Jeffrey Rosen to publicly say there was fraud in the election, according to the report.
"Election fraud is real and prevalent in Pennsylvania. Yet, despite evidence, our Governor and Secretary of State inexplicably refuse to investigate," Mastriano wrote in a December 28 letter to acting Deputy Attorney General Richard Donoghue.

(36,023 posts)Another way to stop them is to be less reactive, give up the habit of shock, disgust, spectator sport politics, 'ain't it awful' talk -- not give them oxygen -- then ACT. And stay at that step.
In messaging, take the profitable deflecting, diverting and coddling as a given, then create media that profitably squash it.
In voting, vote majorities at every level, refuse to allow the media horse race, and just GOTV no matter the hype.
Democrats are as Democrats do.
