Federal judge in Texas throws out Biden administration immigration enforcement guidelines

(CNN) A federal judge in Texas vacated guidelines set by the Biden administration over who is to be prioritized for immigration enforcement, according to a Friday ruling.
Last year, the Department of Homeland Security released guidelines that directed Immigration and Customs Enforcement agents to arrest immigrants deemed public safety or national security risks and recent border crossers. Friday's ruling throws out those guidelines, marking the latest legal setback for the Biden administration on immigration.
The ruling takes effect in seven days.
Judge Drew Tipton of the Texas Southern District Court found that while the federal government has discretion, the guidelines bind officials in a "generalized, prospective manner."

A federal judge in Texas on Friday granted a request by Republican-led states to throw out Biden administration rules that placed limits on whom federal immigration agents should seek to arrest and deport from the U.S., declaring the directive unlawful.
U.S. District Court Judge Drew Tipton said Homeland Security Secretary Alejandro Mayorkas did not have the authority to issue a September 2021 memo (PDF) that directed immigration officials to focus on arresting immigrants deemed to threaten public safety or national security and migrants who recently crossed a U.S. border illegally.
Tipton, an appointee of former President Donald Trump, agreed to void Mayorkas' memo, which was challenged by Republican officials in Texas and Louisiana. But he paused his ruling for seven days to give the Biden administration time to appeal.

I expect it will be appealed since one of the justifications was lack of resources.

(11,986 posts)... the detention of such people may be prioritized over the detention of others. Which also means, for example, whether it's okay to more easily release people who are not deemed to be a danger.
