NY high court nixes Trump appeal, clearing way for testimony

NEW YORK (AP) New Yorks highest court rejected former President Donald Trumps last-ditch effort to avoid testifying in the state attorney generals civil investigation into his business practices on Tuesday, clearing the way for his deposition next month.
The states Court of Appeals said there was no substantial constitutional question that would warrant its intervention in the matter following an intermediate appellate courts ruling last month enforcing a subpoena for Trumps testimony.
The court also dismissed a motion by Trumps lawyers to stay the subpoenas, saying that doing so would be academic, since it wasnt taking up the former presidents appeal in the first place.
Trump and his two eldest children, Ivanka and Donald Trump Jr., agreed last week to answer questions under oath starting July 15 unless the Court of Appeals decided to step in.
A messages seeking comment on Tuesdays ruling was sent to Trumps lawyer. Alan Futerfas, a lawyer for Ivanka and Donald Trump Jr., declined comment. A message was also left with a spokesperson for Attorney General Letitia James....................................................................

(128,979 posts)NY state calls what others call a "State Supreme Court", their "Court of Appeals". So there is no higher court to go to.
Just a few weeks ago, a federal court threw out their filing associated with this - https://www.npr.org/2022/05/27/1101801511/trump-lawsuit-new-york-attorney-general-dismissed-letitia-james and it was rejected because per the judge, the federal courts don't get involved in state investigations and will defer the matter to the state courts to resolve.
