Capitol rioter Guy Reffitt gets longest Jan 6 sentence but no terrorism enhancement

WASHINGTON -- A Donald Trump fan from Texas who attempted to storm the U.S. Capitol while armed with a gun was sentenced to more than 7 years in prison on Monday after a judge denied the Justice Department's request for a "terrorism enhancement" that would have resulted in a lengthier prison sentence.

Guy Reffitt was the first Jan. 6 defendant to go to trial. Reffitt's own son actually tipped off the FBI a couple of weeks before Jan. 6 but didn't hear back until after the attack. The government had an enormous amount of evidence against Reffitt, including his friend's testimony that Reffitt was carrying zip ties and that the duo had made a decision to carry guns because they'd rather be "tried by a jury of twelve than carried by six."

Reffitt was convicted on five counts in March, including transport of a firearm in support of civil disorder and obstruction of an official proceeding, although he did not make it inside the Capitol or use physical violence because he was eventually incapacitated after charging the police line.

In court Monday, Reffitt described himself as "a f**king idiot" and was "not thinking clearly" when he tried to storm the U.S. Capitol.

The prosecution had requested terrorism enhancements and a 15 year sentence. The Trump appointed judge said it wouldn't be fair to sentence him to a much longer term than many others who committed similar crimes (though the others got those sentences in large part because they pleaded guilty and cooperated -- he didn't.)

The range without an enhancement was 87 to 108 months in federal prison, so the judge could have sentenced him to 9 years and still been within the normal range.

This guy should have gotten a 20 year sentence without a chance of parole. All the insurrectionists should also get 20 years in jail.

Kudos to his son, who alerted the FBI about his father's plans and activities.

No doubt these MAGAts gave any thought to their families as they answered Herr Tangerine's call. "I'd rather be tried by 12 than carried by six" sounds tough -- and we know how much TFG loves tough men -- but the reality is his family is going to be without their husband/father for the next seven years. If he was the sole breadwinner, who is going to provide for them while he's in jail? How many of his children growing up experiences is he going to miss?

I imagine his wife will divorce him and move on with her life. Maybe she'll find a nice Democrat to marry.

We need to clear the traitors out of responsibility positions. I'm sure there are people in the country who can judge circumstances and sentencing better than this judge did.

Give up 7 years of your life, branded for life, for the likes of Trump? This is a dangerous man, who wanted to do something horrible to someone he might have been after that day. "Not thinking clearly"?? I guess that's rioter code for, "I regret that I got caught."

All those that plan for more violence should think it through before committing a crime in Trump's name. He isn't worth it. If you are so mesmerized by a narcissistic POS like Trump, you better think two or three times before you violate the civil rights of someone else. Remember, everything that Trump touches dies. Spending 7 years in prison because Trump didn't want to give up power, a power which you won't share in any respect, you won't be the same person. He isn't worth it. Find another way to feed your ego.

But, I'm satisfied with a seven year sentence. The one I want is Trump. Strip Trump of his citizenship and ship him to Russia. Or, Gitmo. I don't care anymore, do you?

Friedrich, a Trump appointee and a former member of the U.S. Sentencing Commission, said that giving Reffitt a sentencing enhancement for carrying a gun during the commission of a crime and for committing a crime of domestic terrorism would create a sentencing disparity with other Jan. 6 defendants.

“There are a lot of cases where defendants committed very violent assaults and even possessed weapons ... that did not receive this departure,” Freidrich said.

Prosecutors had argued that the upward departure for terrorism was warranted because Reffitt was “planning to overtake our government.”
