Judge blocks Indiana abortion ban week after it took effect

INDIANAPOLIS (AP) — An Indiana judge on Thursday blocked the state’s abortion ban from being enforced, putting the new law on hold as abortion clinic operators argue that it violates the state constitution.

Owen County Judge Kelsey Hanlon issued a preliminary injunction against the ban that took effect one week ago. The injunction was sought by abortion clinic operators who argued in a lawsuit that the state constitution protects access to the medical procedure.

The ban was approved by the state’s Republican-dominated Legislature on Aug. 5 and signed by GOP Gov. Eric Holcomb. That made Indiana the first state to enact tighter abortion restrictions since the U.S. Supreme Court eliminated federal abortion protections by overturning Roe v. Wade in June.

The judge wrote “there is reasonable likelihood that this significant restriction of personal autonomy offends the liberty guarantees of the Indiana Constitution” and that the clinics will prevail in the lawsuit. The order prevents the state from enforcing the ban pending a trial on the merits of the lawsuit.

I am glad the judges are on the ball here. I just hope it never makes it to this corrupt USSC.

I think with the extremists in the SCOTUS, you're going to see a dramatic shift in living conditions in red states.

The door has been opened for all sorts of Taliban like laws to go into effect in Red States. They're already legalizing discrimination against LGTBQ citizens. You're going to see all sorts of extreme laws, some we can't even imagine. They are trying to outlawing pornography in some of these places. Alcohol will be in their sights too. It's time we take the Far Right at their word. They actually want to live in societies where women aren't allowed to work or go to school. You're going to see laws passed forcing modest dress for women in some states.

And mark my words, they're going to eventually do everything they can do to stop their citizens from leaving those states. They're already kicking around options for preventing pregnant women from crossing state lines. Eventually there will be states women and their children are escaping from under the cover of night like the Handmaid's Tale. You're going to see a dramatic increase in state power in these states in the form of police forces that have more funding and more sweeping powers to enforce the government's version of morality on the citizens. Take them at their word, they want to live in a society closer to Iran than to California.

I sincerely hope all the hype about Texas going more deep purple than bright screaming red is true. I have less hope for AZ and UT and none at all for OK or WY.

But if I did, no amount of money could make me raise them in a red state. Especially a daughter, they're instituting laws that will make the bodies of women and girls the property of the state if they get pregnant. They're talking about putting pregnant women in prisons to stop them from getting abortions. They're on their way towards Taliban like states. It's truly horrific. And they aren't going to stop with abortion, they have more extreme laws they're itching to implement. Birth Control is going to be outlawed in some US states very soon.

I'm glad that states have more explicit constitutional rights to privacy than our own federal constitution apparently does, although there are several amendments in our federal constitution that suggests- if not outright explicitly tells us- that government wasn't intended by the Founding Fathers to be able to simply invade people's personal space without due process. Of course, our Extreme Court, in its zeal to ban abortion, completely ignored that.
