Georgia Senate candidate Herschel Walker getting tax break in 2022 on Texas home intended for primar

Publicly available tax records reviewed by CNN’s KFile show Walker is listed to get a homestead tax exemption in Texas in 2022, saving the Senate candidate approximately $1,500 and potentially running afoul of both Texas tax rules and some Georgia rules on establishing residency for the purpose of voting or running for office.

Walker registered to vote in Atlanta, Georgia, in 2021 after living in Texas for two decades and voting infrequently. In Texas, homeowner regulations say you can only take the exemption on your “principal residence.”

Walker took the tax break in 2021 and 2022 for his Texas home even after launching a bid for Senate in Georgia, an official in the Tarrant County tax assessor office told CNN’s KFile. The Walker campaign did not respond to CNN’s repeated requests for comment. Walker is set to face Democratic Sen. Raphael Warnock in a runoff election in December after neither candidate earned more than 50% of the vote in November’s midterm election.

Walker is not breaking Georgia law. If he were to win the election he would be required to make his primary residence in Georgia.

doesn't necessarily mean he is a Texas resident.

There are two possible explanations. One is that he is a Texas resident. The other, more likely, explanation is that he is committing tax fraud in Texas. I suspect that Walker is also claiming a homestead exemption for a house in Georgia.

The Texas' Comptroller's web site states:

To qualify for the general residence homestead exemption an individual must have an ownership interest in the property and use the property as the individual's principal residence. An applicant is required to state that he or she does not claim an exemption on another residence homestead in or outside of Texas.


Similarly, the homestead exemption in Georgia is only available for the owner's principal residence. https://dor.georgia.gov/property-tax-homestead-exemptions Logically, you cannot have more than one principle residence - that's what "principle" means.

The Texas application for a homestead exemption contains a verification that the homeowner does not claim a homestead exemption in another state. (I can't seem to post that link.) I am unclear whether the submission of a false claim for a homestead exemption in Texas is a misdemeanor or a felony. Odds are ain't nobody in Texas going to prosecute Walker for a felony.

As long as he claims he lived in the Texas house in 2022 for at least 6 months and one day before the election, he can probably claim it as homesteaded.

I think Georgia law requires a candidate to be living in GA on Election Day, but not necessarily sooner.

How “mean” would magas in Georgia be if Rev Warnock got a homestead exemption in California? They would not only try to stop voting on saturdays, They’d try to stop voting on election day. Because by golly they know stuff.
