Trump Sued by Estate of Capitol Police Officer Who Died After Jan. 6 Attack

WASHINGTONThe estate of Capitol Police Officer Brian Sicknick, who died a day after defending the Capitol during the Jan. 6, 2021, attack, sued Donald Trump on Thursday alleging that the officers death resulted from the former presidents incendiary rhetoric and false claims that the 2020 election was stolen.
In a 47-page lawsuit, lawyers for Mr. Sicknicks estate said Mr. Trump intentionally riled up the crowd and directed and encouraged a mob to attack the U.S. Capitol and attack those who opposed him. The lawsuit cited Mr. Trumps speech at the Ellipse earlier that day, in which he urged a crowd of supporters to fight like hell and march to the Capitol.
As a direct and foreseeable consequence of Defendant Trumps false and incendiary allegations of fraud and theft, and in direct response to Defendant Trumps express calls for violence at the rally, a violent mob attacked the U.S. Capitol, the lawsuit said.
The lawsuit also names as defendants two men convicted in connection with the Capitol attack: Julian Elie Khater, who admitted last year to deploying a chemical spray against Mr. Sicknick and other officers; and George Pierre Tanios, who pleaded guilty to misdemeanor charges stemming from the Capitol attack. Messrs. Khater and Tanios are to be sentenced Jan. 27, court records show. Prosecutors didnt link their actions to Mr. Sicknicks death.

I always figured trump's defense could make a lot of hay out of the "Natural Caused" finding.

Diaz told The Washington Post that the autopsy found no evidence that Sicknick experienced an allergic reaction to chemical irritants. He also said there was no evidence of either external or internal injuries.
"All that transpired played a role in his condition," Diaz told the newspaper.

(31,346 posts)Unless some trump judge dismisses it, I have no doubt that the plaintiffs will have experts to dispute the medical report.
My daughter's death was ruled "accidental" on her death certificate. The woman who killed her was charged with murder. When the death certificate was provided I called the detective up in arms about the "accidental" indication for her death. The detective said that unless they had known each other, because Bekah was run over by a car the coroner would always call the death accidental and it would not be changed.
We prevailed in the wrongful death suit. The Sicknicks also have the disclaimer added by the death investigator and I think their case will go forward and may end up in a win for him and his family.

There are witnesses to this.
Those witnesses should be called to this trial.
Trump should be called to testify what his intentions were if the Secret Service had taken him to the Capitol.

(2,059 posts)Accidental is one thing, and sorry for your loss. But natural causes is a different animal entirely. The defense will cease medical records of not only Sicknick, but family records to see if there are pre existing conditions the family are not aware. A lot of privacy will be invaded.
