No documents with classified markings found in FBI search of Biden's beach home

Last edited Wed Feb 1, 2023, 02:47 PM - Edit history (2)

Source: ABC News

The FBI conducted a "planned search" Wednesday of President Joe Biden's home in Rehoboth Beach, Delaware, according to Biden's personal lawyer amid an ongoing probe into the potential mishandling of classified documents.

Biden's attorney said no documents with classified markings were found, but "DOJ took for further review some materials and handwritten notes that appear to relate to his time as Vice President."

The search took place for three and a half hours -- from 8:30 a.m. to noon ET.

"Today, with the President's full support and cooperation, the DOJ is conducting a planned search of his home in Rehoboth, Delaware," wrote Bob Bauer, personal attorney for the president, in a statement after pool reporters spotted four vehicles there. "Under DOJ's standard procedures, in the interests of operational security and integrity, it sought to do this work without advance public notice, and we agreed to cooperate. The search today is a further step in a thorough and timely DOJ process we will continue to fully support and facilitate. We will have further information at the conclusion of today's search."

After Attorney General Merrick Garland appointed Robert Hur as special counsel last month to investigate the potential mishandling of classified documents, Hur was expected to formally begin his work this week, according to a source familiar with the investigation.

Wednesday marks the second DOJ search the president's lawyers have acknowledged. The first was the nearly 13-hour search of Biden's Wilmington, Delaware, home on Jan. 20, disclosed on Jan. 21, which found additional classified documents after Biden's attorneys searched the home themselves in December and found some classified materials, the president's lawyers have said.

"Under the regulations, the extraordinary circumstances here require a special counsel appointment for this matter," Garland told the public.

And that would require DOJ to get a search warrant based on a showing of probable cause, supported by evidence, that there were documents unlawfully stored at the other Trump properties. The fact that documents were found at Mar-a-Lago, standing alone, might not be enough to convince a judge to issue the search warrant without evidence relating to the other properties.

You would have the cart put before the horse. As tempting as that might be given that its Trump, its not consistent with the Fourth Amendment.

For example, if you were stopped while out and about and discovered to have in your possession a controlled substance, that fact alone would not create probable cause to search your home.

Nothng against the OP or others who are following the story, or those who think it is really important. I just think the whole thing is a matter of papers falling through the cracks in a system for keeping secret docs secret that is obviously flawed. They are now finding papers in the homes of military officals, etc. It's a matter of intent. Biden had no bad intentions, dump did. Biden cooperated, dump didn''t.

Will it hurt the case against dump or help repugs in their ongoing both siderism attempts? I don't know but I doubt it. And I really don't think it will matter in 2024.

Biden is voluntarily allowing a search. If Trump doesn't do the same, the only recourse is to get a search warrant and that requires probable cause and the discovery of documents at one site doesn't in and of itself create probable cause to search other sites. To give a more pedestrian example, if you were caught out and about in possession of a controlled substance, that discovery, in and of itself, would not create probable cause to search your house.

Trump is playing master criminal while MG has been crossing his t's and dotting his i's for the 20th fucking time. Trump should have been nailed on this immediately, but now the right can build a whole other case against Biden for "doing the same thing" as Trump. 1/6 has been allowed to languish as well, as far as Trump and his inner circle are concerned.

NO Classified Docs Found At Biden's Beach House

By Red Painter — February 1, 2023

The FBI conducted a *planned* search of President Joe Biden's Rehoboth Beach home and found ZERO documents with classified markings. Let me repeat myself - this was PLANNED (meaning NO subpoena) and NOTHING was found with even one classified marking. In the entire house. Biden's attorney, Bob Bauer, did say that the FBI took a few handwritten notes for further review, but they did not have classified markings on them. The search lasted approximately 3 1/2 hours.

Mr. Bauer told the media ..........................

None of the searches by the FBI required a warrant or subpoena, unlike the case of Donald Trump's Mar-A-Lago search warrant case.

Even though nothing was found, Kristen Welker had to be the Chuck Todd of daytime cable television, adding: "That last line is significant, Chris, because they wouldn't have taken these notebooks and other items if they weren't of some interest. So we'll have to see what, if anything, comes of that."

and that was as a result of this from December - https://www.democraticunderground.com/10143004559

So with testifying in a grand jury, it takes the seriousness up a notch for those individuals regarding how these folks did their search.

The main reason why the feds were able to go ahead with doing Mar-a-Lago was because they had interviewed staff there earlier and had some "inside help" to be able to explicitly state on the warrants WHERE to search (within the complex) and WHAT was to be seized. They might not have had that kind of detail to do the same sort of seizure warrant for the other properties, although this testimony that just happened might just help in that regard.
