DeSantis: Florida won't cooperate with Trump extradition

Florida Gov. Ron DeSantis (R) on Thursday called the indictment of former President Trump “un-American” and said the state would not assist in any extradition request.

“The weaponization of the legal system to advance a political agenda turns the rule of law on its head. It is un-American,” DeSantis, who is seen as Trump’s top rival in a potential 2024 GOP primary, tweeted after news of the indictment broke.

“The Soros-backed Manhattan District Attorney has consistently bent the law to downgrade felonies and to excuse criminal misconduct. Yet, now he is stretching the law to target a political opponent,” DeSantis continued, adding that Florida would not assist in an extradition request “given the questionable circumstances at issue.”

The Extradition Clause in the US Constitution requires states, upon demand of another state, to deliver a fugitive from justice who has committed a "treason, felony or other crime" to the state from which the fugitive has fled.

18 U.S.C. § 3182 sets the process by which an executive of a state, district, or territory of the United States must arrest and turn over a fugitive from another state, district, or territory.

Its not common but it happens and nothing is done about it. Northern governors often refused to extradite fugitive slaves before the civil war.

There are grounds to deny extradition, from what I read. But I'm not seeing any indication of grounds to deny.

Florida has adopted the Uniform Criminal Extradition Act, which from what I read, eases extradition between states.

The DoJ has personnel to make the arrest if he does not turn himself in, which I think he will. Trump wants no perp walk for the cameras.

DeSantis' statement is meant to shore up his standing with Trump's base, which he will need. DeSantis could be the last man standing and benefit politically, but then again, Trump could run from prison and win as a martyr.

I think that last scenario is unlikely — people will give up on a prisoner for president — but I've learned to never say never with this guy.

Im pretty sure NY,NJ and a host of other places could go after his businesses and property if hes a fugitive. start with pulling liquor licenses. also I doubt most major banks would want to do business with a fugitive run company. Im sure federal rgulators would also want to look at banks dealing with fugitives

Isn't this what the justice system does every single day? Meatball has not seen the evidence or heard the testimony. He literally doesn't know what he's talking about. Imagine that.

Article 4, Section 2:

A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime.

Besides, can't the head of the Secret Service simply call Trump's detail and tell them to bring him to New York?

I read on mastodon that the orange fuckstick's lawyers went to DeFascist and so he came out with this statement - BEFORE the orange fuckstick said he'd voluntarily show up for the arraignment.

Not only would it be illegal for DeFascist to block any sort of extradition, it won't even be necessary!

He got played. Badly.

However, I sincerely hope there will be a MAJOR, FEDERAL response should he try to interfere with the extradition. This includes not being able to control his own population should any of them try to interfere with the extradition. I cannot wait to watch him being forced to sic the police on his own people. And, if he does not... well, that makes him an unviable public servant, does it not?
