California Bar Slaps Trump Lawyer John Eastman with 11 Disciplinary Charges for 'False' Election Fra

The California bar slapped former President Donald Trumps attorney John Eastman with nearly a dozen disciplinary charges for false and misleading statements alleging fraud in the 2020 election.
The State Bar of Californias Chief Trial Counsel George Cardona intends to seek Eastmans disbarment for alleged violations of Business and Professions Code section 6106, which punishes making false and misleading statements that constitute acts of moral turpitude, dishonesty, and corruption.
There is nothing more sacrosanct to our American democracy than free and fair elections and the peaceful transfer of power, Cardona said in a statement. For California attorneys, adherence to the U.S. and California Constitutions is their highest legal duty. The Notice of Disciplinary Charges alleges that Mr. Eastman violated this duty in furtherance of an attempt to usurp the will of the American people and overturn election results for the highest office in the land an egregious and unprecedented attack on our democracy for which he must be held accountable.
Eastman is the author of the so-called coup memo, a six-point plan to overturn the election results.
The 11 charges arise from allegations that Eastman engaged in a course of conduct to plan, promote, and assist then-President Trump in executing a strategy, unsupported by facts or law, to overturn the legitimate results of the 2020 presidential election by obstructing the count of electoral votes of certain states, the bar wrote in a press release.

(43,357 posts)Like most right wingers, his thinking was half-assed, since as an alleged constitutional lawyer he acted like the 12th Amendment didn't mean what it says. Even after he clerked for J. Michael Luttig who included him as part of the "clear and present danger" in his testimony at the Jan 6 Committee hearing on June 16 2022.
Gotta say, though, that the CA Bar sure took its sweet time to act on this guy.
Following law school, he clerked for Judge J. Michael Luttig at the United States Court of Appeals for the Fourth Circuit and for Justice Clarence Thomas at the Supreme Court of the United States; he then was an attorney with the law firm of Kirkland & Ellis, specializing in civil and constitutional litigation. He later joined Chapman to teach constitutional law. He has also appeared on conservative pundit Hugh Hewitt's Fox News program The Hugh Hewitt Show, commenting on law.[26]
Eastman served as an attorney for the State of South Dakota, representing it in a denied petition to the U.S. Supreme Court in a constitutional challenge to federal spending.[27]
Eastman has represented the North Carolina legislature and the State of Arizona in unsuccessfully petitioning the Supreme Court in cases involving same-sex marriage,[28] abortion,[29] and immigration.[30]
He testified before the Senate Judiciary Committee in 2014 arguing that President Barack Obama's unilateral suspension of deportation for undocumented immigrants was unconstitutional.[31]

(4,741 posts)The campus is north of CA 22, and Tustin is well south of that freeway. I had to get on and off the freeway at the Chapman exit every single day for work, so I know the area well.
Calling it a rw school is entirely justified. That note about Eastman doing Hewitt's radio show? Hewitt, the moron rw pundit, is also a professor at Chapman, to this day. Tom Campbell, former rep for CA-12/15 (R) was a professor there as well. Total scumbag. But so is Hewitt. Telling that Wikipedia leaves that out, and leaves out Eastman on the main Chapman page.
Why Wiki is not a fit source for citations. The information is subject to bad actors contributing slanted information to it, or removing unflattering information as well.

The rest of Wikipedia's entry on Eastman is factual. I will use Wikipedia every chance I get. I donate to it every year.

(53,394 posts)Disbarment takes some time and if they left you running around unchecked you could screw up a lot of people before they were able to pull your license. By doing this it keeps you from doing any more damage.

(5,838 posts)Eastman will either be disbarred, suspended for a particular time, or allowed to practice under certain remedial terms and this latter would most likely be with certain conditions including a probation monitor.
I have seen attys disbarred for much, much less.

CNN President Donald Trump personally asked Republican Sen. Ted Cruz of Texas if he would argue a long-shot election lawsuit seeking to overturrn the election results in four battleground states, should the Supreme Court agree to take it up, two sources told CNN on Wednesday.
Trump inquired on Tuesday whether Cruz would argue the case, which was filed by Texas Attorney General Ken Paxton on Monday night in an effort to block election results from Georgia, Michigan, Pennsylvania and Wisconsin, all of which were won by President-elect Joe Biden. Cruz agreed to do so, according to a spokesperson. A source familiar with the conversation said Trump has asked Cruz to argue a number of these election challenges.

News of Cruzs potential involvement comes after Trump got involved in Paxtons case on Wednesday, asking the Supreme Court in a court filing to block millions of votes from the four states. The President is being represented by a new attorney, John Eastman, who is known for recently pushing a racist conspiracy theory that claimed Vice President-elect Kamala Harris was not eligible for the role because her parents were immigrants.

Cruz, who has argued nine cases before the Supreme Court, tweeted Monday that he stood ready to present the oral argument in a case from Pennsylvania Republicans urging the court to block certification of the commonwealths election results. On Tuesday, the court denied the petitioners request to hear the Pennsylvania case, delivering a near fatal blow to the GOPs long-shot bid to invalidate Bidens victory.
