Jury says Trump must pay E. Jean Carroll $5 million for sexual abuse and defamation

Last edited Tue May 9, 2023, 08:22 PM - Edit history (2)

Source: CNBC

A civil jury on Tuesday found former President Donald Trump liable for sexually abusing the writer E. Jean Carroll at a New York department store in the 1990s, and for defaming her last fall when he denied her claim.

The jury of six men and three women also ordered Trump to pay Carroll a total of $5 million in compensatory and punitive damages after deliberating less than three hours in U.S. District Court in Manhattan.

Jurors notably did not find Trump liable for rape, the most serious allegation Carroll made in a lawsuit filed last year. But their verdict that he sexually abused and forcibly touched her without her consent during a chance encounter in the Bergdorf Goodman store substantiated her civil claim of battery. Trial in the case began on April 25.

“I filed this lawsuit against Donald Trump to clear my name and to get my life back,” Carroll, 79, said in a statement Tuesday. “Today, the world finally knows the truth,” said Carroll, a former “Elle” magazine advice columnist and biographer of gonzo journalist Hunter S. Thompson.

The jury of six men and three women ordered Trump to pay Carroll $5 million in compensatory and punitive damages.

The verdict in the civil trial came after less than three hours of deliberations in U.S. District Court in lower Manhattan. The jury notably did not find Trump liable for rape, as Carroll had alleged.

"I have absolutely no idea who this woman is. This verdict is a disgrace," Trump wrote in a post on his social media site Truth Social. A spokesman for his 2024 Republican presidential campaign said, "This case will be appealed, and we will ultimately win." Carroll's lawyer Roberta Kaplan said, "We are very happy," as she left the courthouse with her client. Carroll did not speak to reporters.

The verdict is the latest legal blow against Trump, who leads early polls for the 2024 GOP nomination. In late March he was indicted by a Manhattan state Supreme Court grand jury on nearly three dozen counts of falsifying business records in connection with a 2016 hush money payment to porn star Stormy Daniels.

Carroll, 79, claimed in her lawsuit that Trump raped her in a dressing room of the Bergdorf Goodman store in the mid-1990s. Trump cannot be prosecuted for the alleged rape because the statute of limitations for such a crime has long since passed.

even though that is what most likely occurred. No rape kit or other forensic evidence, reasonable doubt. It shouldn't be that way, but it is.

Now to assess damages for a lifetime of PTSD and "ick" whenever she needed something Bergdorf's sold or saw his piggy face on the news.

This shows he's vulnerable. Even if it's only a scratch, it still puts some blood in the water.

The definition of rape in New York State, per the judge's instructions, requires that Trump inserted his penis into Carroll's vagina. She testified that she wasn't sure that occurred. Hence, the decision.

Trump was found liable of sexual abuse. He didn't get off.

In fact, they've ruled against him, and Republicans, frequently.

You must remember, the people on the Court are set for life. They don't owe anybody anything. The people who put them there may think they're owed something, but their leverage approaches zero.

The people on the USSC have an agenda, and that agenda does not include making everything all better for Donald Trump. Or even the GOP in general. Only insofar as the case is somehow important to that agenda -- which this one is not -- will they intervene. Mr Trump's best hope is to find a court in the process of appeals short of the USSC which he can influence.
