Former President Donald Trump on Tuesday said he has been told he is a target in the Jan. 6 criminal investigation by special counsel Jack Smith. Trump is the leading contender for the 2024 Republican presidential nomination. Smith already has criminally charged Trump with about three dozen counts related to retaining classified documents when he left the White House.

Trump also suggested he may soon face indictment for the Jan. 6 probe, which is focused on Trump’s efforts to overturn his loss in the 2020 election to President Joe Biden. Trump posted his statement on his Truth Social account. Two sources with direct knowledge of the probe confirmed to NBC News that Smith sent Trump a target letter in the case.

“Deranged Jack Smith, the prosecutor with Joe Biden’s DOJ, sent a letter (again, it was Sunday night!) stating that I am a TARGET of the January 6th Grand Jury investigation, and giving me a very short 4 days to report to the Grand Jury, which almost always means an Arrest and Indictment,” Trump wrote on his Truth Social site.

A spokesman for Smith declined to comment. A hearing in the classified documents criminal case is set for Tuesday in Florida federal court. Trump’s lawyers have asked that any trial in that case take place after the 2024 election. Smith’s prosecutors oppose that bid. Trump is separately under criminal investigation by a Georgia state prosecutor for his attempt to get election officials there to reverse his loss to Biden in Georgia.

But what seems still up in the air is whether they roll the "fake electors" scheme into this (I believe there were different grand juries) or do that separately.

I haven't turned on the TV yet because I know they are going wild...

There will be conspiracy allegations. There was a plan to block the peaceful transfer of power and several acts taken in furtherance of this plan which will support a conspiracy. Georgia has a much loser RICO law and I understand that Fanni Willis will like use that theory in her indictments.

Again, I am corporate lawyer whose hobby is election law and voter protection.

What the degree allows you to do is have tort background and access to case sources.

IIRC, Smith brought in some "specialty" lawyers to assist, so it will be interesting to see what they come up with.

He has to stop somewhere long before that. Most likely Ireland or Scotland, but he might be able to get to a few countries with Atlantic seafront, save for Norway.

Problem: None of those Atlantic seaboard countries in Europe are fond of him, and I doubt any of them retain enough good will toward him to aid and abet his attempt to escape prosecution in the US.

That's why he won't fly the coop. He knows he's bollocksed if he tries it.

But if it's before a jury is sworn in, it's appealable and not double jeopardy to refile.

Only way she could get the case thrown out permanently on her own would be to grant a directed verdict in Trump's favor after the jury is empaneled.

she has two paths today..judicious/follow the law or Trump advocate/cheerleader and the 11th Circuit says "WTF!"..


as for Trump the J6 Target..I think this was Jack Smith's plan all along..once the documents case landed in Cannon's court and the 50/50 prospect of her doing the right thing, Smith was ready to indict Trump in New Jersey/DC...

The indictments will bring out his supporters in droves, but they will also bring out his opponents, and there are more of us.

If the trial is over and he is convicted, he might not be able to run in 2024. Depending on what the specific charges are, a conviction might disqualify him from office.

You can be sure that the fascist party knows this, too, and will have someone lined up to take his place. They will make him a martyr and try to draw in votes on that.

IF someone else runs in Trump's place, the fascist party platform will not change. They still intend to turn the presidency into a dictatorship if they get the power. All the more reason for us not to get complacent, and to make sure that Biden wins and gets the Congress that he needs to preserve democracy.

Thus will be the "trial of the century."

Oh, I missed that one. How silly! It's difficult for me to understand what motivates people who are conspiracy theorists or who continually engage in paranoid or defeatists speculation. I see no reason that anyone should distrust Joe Biden's judgement or for anyone to be resentful of him.

they normally go to for confirmation. I think they all initially reported that "he said" but those with actual sources sought them out and reported a confirmation or not. I think some like the NYT & WaPo are burying their ledes by not reporting some independent confirmation, although it's possible their bosses want a definitive source before "confirming" either way.

he's already got the charges ready to file in the same DC courthouse where the grand jury votes and can file them on the same day. That's why I'm thinking probably Friday or Monday.




Cannon, will soon see
-- that Jack Smith won't be delayed no matter how indulgent she is of trump defense team's bullshit due process dance, so perhaps today's pre-trial docs and scheduling hearing will present her at her best. We'll see what that looks like;
-- another federal judge who'll show her how the trial process is properly and ethically done.

Then freaked out when receiving a summons with a notification of an indictment (on Thurs. Jun. 8 and was told to appear on the following Tuesday) - https://www.democraticunderground.com/10143085552

(this was the same classified documents case that is going on right now in FL with Loose Cannon)

Similarly, there were rumblings about Alvin Bragg wrapping things up and 45 claiming he was about to be arrested, although NY did a "head fake" about the grand jury not considering the issue as they would be working on another case, and might not get back to it until at least April... until they dropped the bomb of a vote and indictment 12 days later (Mar. 30) - https://www.democraticunderground.com/10143053042

So I expect in both cases, he had been invited to testify (via the target letter) and declined. I.e., in NY and I expect this notice is that opportunity.

So for this 3rd case, it seems to suggest that the grand jury (if they haven't already done so) plans to meet and vote possibly this week on the indictment(s) and this might be his last opportunity to put his 2 cents in to the grand jury before the indictments drop.

... before he asks Cannon to postpone the Florida trial indefinitely (today). She now has no justification to push it past the election because it's likely the J6 trial will happen before the election anyway.

Keep in mind that this one will be in DC.

And remember, he does not have to be convicted of insurrection to be barred from the ballot. The Constitution does not require a conviction. I have heard that several secretaries of state have been conferring about keeping him off the ballot. Just the indictiment may push them to make that decision.

1) The US Government uses only USPS mail.

2) The only USPS letter mail that gets delivered on a Sunday would be Express mail, and I seriously doubt that the DOJ would send a target letter that way--they send out too many, and that would become too expensive. Last I heard, they used certified mail for something like that. Which, while a small step up from first class or Priority letter mail, still doesn't rate Sunday delivery.

Since it's likely that he's lying about when he got it, he's probably lying about a whole bunch else.

I'll wait for Smith to make an announcement before I take seriously anything this evil psychopath has to say.

Not correct. The federal government uses all sorts of shipping and delivery services including USPS. GSA awards contracts for vaious types of deliveries (including "freight" ) that might include Fedex or DHL or UPS. There is no restriction to only using USPS.

I'm afraid you went down the rabbit hole. The government will literally contract "couriers" to hand-deliver. And USPS has "same day" and usually correspondence from a federal agency to a regulated company will be sent "certified".

(I was a fed for 30+ years and had to deal with all the different ways we were sending out correspondence and packages to our regulated industries)

I'm going on what most government agencies have done in the past--which is use only USPS mail. Maybe that's changed, and, to me it's not for the better.

And I forgot that they could deliver a subpoena by hand.

and you are incorrect. Anyone who DID work for the feds knows this. There is nothing "presumptuous" about "facts" versus "guessing".

USPS doesn't "deliver" to Antarctica but there would be a contractor who could fly in and deliver mail and parcels. GSA handles that process for the entire federal government.
