Washington CNN Negotiations between Donald Trumps lawyers and Fulton County District Attorney Fani Willis office over the details of his surrender are expected to continue into next week, a source with knowledge of the talks tells CNN.
This means the former presidents surrender is expected next week not Thursday or Friday before the August 25 deadline. CNN previously reported on Wednesday that talks were underway between Trumps team and Willis prosecutors.
The Fulton County sheriff has said that all 19 defendants in the case, including Trump, are expected to surrender at the Fulton County jail, as is common procedure. The former presidents surrender and arraignment will look different in Georgia than in his previous three criminal cases.
Fulton County Sheriff Pat Labat has previously suggested he wants to treat these defendants the same as any other defendant would be treated, which means they would have mugshots taken and be fingerprinted. However, the authorities in Fulton County will need to coordinate with the Secret Service and Trumps attorneys about the logistics of the former presidents surrender.

(40 posts)Trump goes to jail and learns how to actually be a leader there in his POD. Maybe he can get them some jell-O or cookies or some extra TV time.

(3,386 posts)That could be the most embarrassing aspect of the whole situation. I'm sure he's put on a few pounds since his notorious "239 pounds" from 2018; Las Vegas has probably established an over/under for his new weight. Should be interesting.
My best uneducated guess.

(6,115 posts)Wait a minute. Maybe she gave him plenty of time to attack her and the grand jury and make it much worse for himself when he is arraigned. Maybe this was strategic.
I'm not so sure they won't make special accommodations anyway.
But in case they don't, can anyone tell me how this might work? He surrenders at the jail, they fingerprint him, book him etc., and does he then ride a prison transport to the courthouse for the arraignment with whichever magistrate judge is on the bench that day? Isn't that how they do this with "normal" defendants? I mean, if he's a normal defendant...

(169,753 posts)So it gives them all 2 weeks to roll in whenever... as long as they all show up by Aug. 25 and get processed.
From one of those legal portal sites, this is the process - https://www.nolo.com/legal-encyclopedia/arraignment-georgia.html
Find information about the early goings in Georgia criminal cases, including determinations of bail and "probable cause."
By Michael Tarleton
In Georgia, the defendant's first appearance before a judge is often called an "initial appearance." "Arraignment" refers to the hearing at which the prosecution announces the charges it has filed; at that point, the defendant typically responds by pleading either guilty or not guilty.
Timing of the Initial Appearance
An arresting agency or county sheriff's department must bring someone who's been arrested without a warrant before a judicial officer (a magistrate or judge) within 48 hoursunless the person has already bailed out of jail. (Ga. Code § 17-4-62; Ga. Unif. Super. Ct. R. 26.1.) The timeframe is 72 hours if there was a warrant for the arrest. (Ga. Code § 17-4-26; Ga. Unif. Super. Ct. R. 26.1.) (For someone who has bailed out of jail, the next court appearanceeither a commitment hearing or an arraignmentmay be several days or a couple weeks later.)

So in that group's case, they have all been indicted and charged and have warrants, so an arraignment in court needs to happen up to a couple weeks after they are processed if they are not being held in jail.
Since few of them (except maybe a couple Electors) live in the state, they would all need to travel back and forth. So they will have to schedule an arraignment (or might even be assigned a date to appear). The fact that the Jail is "open 24/7" but the courts aren't, means they would have to do some juggling along with everyone else down there who get arrested (those non-affiliated with this case), to schedule with a judge.
I don't know if there would be any accommodation for 45 to actually get it done all on the same day though (which is probably what all this "negotiating" is about per the OP).

(6,115 posts)I'm getting caught up in semantics.
So, does the sheriff escort him to the judicial officer? Is there some sort of process with a judicial officer in the jailhouse? And who sets bail is he hasn't seen a judge yet? If he surrenders and gets booked, he's in custody. Who decides if he can have bail if it isn't the magistrate judge?
Any lawyers out there who understand this process?
