Judge in documents case lays out rules for Trump's access to classified information

Source: CBS News

September 13, 2023 / 3:39 PM

Washington — The federal judge overseeing the case involving former President Donald Trump's handling of sensitive government documents on Wednesday laid out a series of restrictions over where and how the former president can review and discuss classified information with his lawyers as they prepare for their upcoming trial.

The 16-page protective order was issued by U.S. District Judge Aileen Cannon, who granted a request from special counsel Jack Smith that laid out procedures Trump and his lawyers must follow when handling classified information disclosed to them in connection with the case. The order comes after lawyers for the Justice Department and the former president appeared before Cannon in Florida on Tuesday for a sealed hearing about the government's request.

Under the rules laid out by Cannon on Wednesday, all classified information "produced, possessed, created or maintained" by Trump and his legal team or disclosed to them by the government must be stored and kept in a secure facility established by a court-designated classified information security officer. Classified information can only be discussed within the secure location, formally known as a sensitive compartmented information facility, or SCIF, "or in an area authorized" by the security officer, according to the order.

The security officer is tasked with providing security arrangements necessary to protect against the unauthorized disclosure of classified information made available to Trump in connection with his case, and can provide guidance to the former president and his lawyers regarding the handling and use of sensitive materials.

He MUST go to where the Documents are being kept under GUARD, and lock and key if he wants to look at them.

Good! Make him make the time.

If he can’t steal them and sell them, they’re of no use to him. Besides, seeing all the documents that landed him in hot water reminds him of how big a LOSER he is.

The defense is allowed to see the evidence the prosecution has against them, that's called Discovery, whether or not Benedict is a civilian now, that's been a cornerstone of our criminal justice system for, like, ever.

He's going to have a tough case to prove to a jury.

Let's pretend bringing the documents to MAL was an honest mistake. But when he withheld them for a year after the National Archives requested them, and then even withheld many boxes after a SUBPOENA, that can't be attributed to a simple mistake.

(although obviously not routinely either), there are "boilerplate templates" that can be used (which include citations to requisite statues) to do it and she just needs to fill in names, dates, and other case details. Few try to "reinvent the wheel".

As a similar example, DOJ has always used templates for their dockets (we had to use them in our agency preliminarily and then forward to our agency lawyers for cleaning up before they were handed off to DOJ to further polishing).

And refer to them that way instead of letting him see the contents of ANY classified material. It's clear he can't be trusted and it appears even Cannon knows that (or maybe a stopped clock is right twice a day). He's a massive security risk and IMO he should not have access to the contents of the documents. I understand about discovery but why can't they still keep the contents from him while describing the type of document?

Even Biden barred him from receiving the classified briefings that are routinely allowed ex-presidents.

Seems to me that a document describing war plans with Iran isn't actually relevant to his defense.
