Trump Asks Supreme Court to Put Off Hearing Case on Immunity Claim

Former President Donald J. Trump urged the Supreme Court on Wednesday to put off a decision on a crucial question in his federal prosecution on charges of plotting to overturn the 2020 election: whether he has “absolute immunity” for actions he took as president.

The question, Mr. Trump’s brief said, should be “resolved in a cautious, deliberative manner — not at breakneck speed.” He urged the justices not to “rush to decide the issues with reckless abandon.”

The request appeared to be part of Mr. Trump’s general strategy of trying to delay the trial in the case, which is scheduled to start in March.

Last week, Jack Smith, the special counsel, asked the Supreme Court to bypass a federal appeals court and agree to hear the immunity question on a quick schedule. Mr. Trump opposed that request on Wednesday, saying the importance of the matter warranted careful and unhurried deliberation by the appeals court before the justices decide whether to take it up.

TFG knows that the immunity argument is a loser. The 11th Circuit opinion has some great language on this defense in the Meadows removal opinion. TFG filed this motion solely to delay things and now TFG's attorneys are begging the SCOTUS to not review this issue on an expedited basis.

Lawyers for Donald Trump on Wednesday urged the US supreme court to reject a request from the special counsel to expeditiously decide whether he was immune from prosecution over his efforts to overturn the 2020 election results, contending prosecutors lacked standing to bring the petition......

The Trump legal team suspected the motion would fail, according to people familiar with the matter, but filed it in the knowledge that it could be appealed before trial and, crucially, that it would cause the case to be paused pending the outcome of the appeals process.

Trump’s lawyers appeared to expect the DC circuit to take months to schedule oral arguments and issue a ruling. They only intended to take the matter to the supreme court after a possible loss, which could again take months to decide whether Trump could be prosecuted in the case.

But prosecutors pre-empted Trump and forced him to contend with the supreme court plank of his delay strategy earlier than he expected, requesting a grant of what is known as certiorari before the DC circuit issued a judgment. Prosecutors also separately asked the DC circuit to expedite its consideration.....

Trump has also made no secret that his overarching legal strategy, for all of his criminal cases, is to pursue procedural delays. If the cases do not go to trial before next year’s election and he wins a second term, then he could direct his handpicked attorney general to drop all of the charges.

If TFG had a valid defense to these indictments, TFG would be moving for expedited review. TFG's attorneys know that these claims are losers and so want to slow things down.
