Trump back on ballot in Colorado while state Republicans appeal ban to Supreme Court

The Colorado Republican Party on Wednesday appealed that state's Supreme Court decision that found former President Donald Trump is ineligible for the presidency, the potential first step to a showdown at the nation's highest court over the meaning of a 155-year-old constitutional provision that bans from office those who "engaged in insurrection."

The first impact of the appeal is to extend the stay of the 4-3 ruling from Colorado's highest court, which put its decision on pause until Jan. 4, the day before the state's primary ballots are due at the printer, or until an appeal to the U.S. Supreme Court is finished. Trump himself has said he still plans to appeal the ruling to the nation's highest court as well.

Colorado's Secretary of State Jena Griswold said Thursday that, with the appeal filed, Trump will be included as a candidate on the state's primary ballot unless the U.S. Supreme Court declines to hear the case or upholds the state supreme court's ruling.

The U.S. Supreme Court has never ruled on Section 3 of the 14th Amendment, which was added after the Civil War to prevent former Confederates from returning to government. It says that anyone who swore an oath to "support" the constitution and then "engaged in insurrection" against it cannot hold government office.

The court’s ruling was stayed pending appeal. It’s still stayed. The difference is that instead of expiring a week from now, it will when SCOTUS either rejects the case or rules on it

I'm not convinced he was going to appeal it.

Look, it was only one state he wasn't going to win anyway, and it was going to energize his base to send him money.

No other state currently looks like they will toss him from the primaries, and if any try for the general, he can claim its too close to the election.

Plus, there is the real possibility they could slot someone without his baggage who could win CO and deny the EC votes to biden.

If biden doesn't get to 270, stinky will win when the house votes in a new potus. It doesn't matter that stinky also didn't get to 270, the constitution requires at least one candidate to get 270 or it goes to the house.

So that may have been stinky plan. If it goes to scotus, and they rule for or against him, it will apply to every state.

This is why I have learned I have to face reality: trump will never face justice. That just isn't how the world works.
I have to face reality that the US is dominated by racist religious extremists and it will never be the country I hoped it could be.

We have to realize while I have no doubt we have greater numbers, we are under the tyranny of the minority and there is no way to fix that. This country is lost

As it's becoming crystal clear that the justice system has no intention of holding him accountable.
Even if voters reject him again, it will be weeks of legal fights again and on and on and on ad nauseum

Not sure exactly who I’m targeting here but I do feel that somehow somewhere there is a good amount of cognitive dissonance where this is concerned.

They said if it was appealed to SCOTUS, the ban would be delayed until the SC released a decision.
The SC was always going to make the final decision as to whether Trump can run or not.

So it’s nearly certain that he will be on all the ballots.
